19.0 CRIMINAL HISTORY
A criminal history is a chronological record of an individual’s criminal arrests, judicial dispositions,
and dates of confinement or other corrections supervision, established and based on positive
fingerprint identification.
19.1 OREGON CRIMINAL HISTORY RECORDS
The Oregon Criminal History File (CCH) is compiled and entered into LEDS by the Oregon State
Police - CJIS Division (OSP-CJIS). Arrests for all felony and misdemeanor sex and drug crimes
are mandated to be submitted to OSP for the purpose of establishing and maintaining Oregon’s
Criminal History File. The following data segments may be found within a CCH record.
(1) ARREST DATA. When an individual is arrested for a criminal offense, the information
used at time of arrest, including the date of arrest, offense for which arrested, and
arresting agency are entered onto a card containing the individual’s fingerprints. This
card is then sent to the Oregon State Police CJIS Division by the arresting agency. If
the individual identified by fingerprints has an existing criminal record, the new arrest is
added to the previous record. If no prior record exists, a state identification number
(SID) is issued and a new record is established for that individual.
NOTE: Descriptive information (e.g. name, DOB, SOC.#) is information provided or
used by subject at arrest and may not reflect the true identity. This data should be
considered for reference only; true identity can only be established by fingerprints.
(2) JUDICIAL DISPOSITION DATA. Once an individual has been convicted, acquitted, or
some other disposition has been rendered by the court, the data are collected by the
courts or the Oregon Judicial Information Network (OJIN). Dispositions are submitted
manually or by electronic transmission from OJIN. Those dispositions with an asterisk
(*) indicate electronic submission from OJIN onto the CCH.
(3) CUSTODY DATA. When an individual is sentenced to prison, a fingerprint card is
submitted to the Oregon State Police CJIS Division by the Department of Corrections.
The information on the fingerprint card includes the date the individual was received into
custody, the crime(s) that they are in prison for, the county that the crime(s) were
committed in, the sentence for each charge, the court case number for each charge,
and whether multiple charges are to be served consecutively or concurrently. For parole
violation, there is sometimes a maximum release date instead of a sentence. If an
individual violates their post-prison supervision, a fingerprint card is submitted with the
length of their sanction. After positive identification by fingerprints, all custody
information is entered into the criminal history record. A report is received monthly
listing individuals that have been released on parole or post-prison supervision. This
information is also entered into the criminal history record.
(4) INTERSTATE COMPACT DATA. When an individual is accepted for supervision from
another state, the parole and probation officer submits a fingerprint card. The
information on the fingerprint card includes the charge they are being supervised for,
the state where they committed the offense, the sentence, the date they were paroled
and the date that parole or probation was accepted in Oregon. A SID number is issued
and a new record is established for that individual.
(5) APPLICANT DATA. When an agency sends an applicant fingerprint card to the Oregon
State Police CJIS Division for criminal history check, based on the agency’s authority,
an Oregon and/or FBI check will be made. Cards to be retained will have an entry made
into CCH. An applicant segment does not necessarily indicate active employment with
an agency, the issuance of a license or permit, or any type of certification, it simply

indicates application for the stated purpose and agency and that entry was established
by fingerprint comparison. A response to an inquiry matching an applicant record is
shown in Section 19.5.7.
19.2 NATIONAL CRIMINAL HISTORY RECORDS
19.2.1 NATIONAL FINGERPRINT FILE
The Identification Division of the Federal Bureau of Investigation maintains a national fingerprint
card file similar to that maintained by state identification bureaus.
On May 1, 1994, Oregon became the third state to fully participate in the FBI National Fingerprint
File (NFF). The net effect of participating in NFF is that for the first arrest, both the Oregon and
FBI fingerprint cards need to be sent to the Oregon State Police CJIS Division (OSP-CJIS) for
processing and establishing the initial records. OSP-CJIS forwards the FBI fingerprint card to the
FBI Identification Division. Subsequent arrests will only require submission of the Oregon
fingerprint card, not the FBI card.
Caveats are added to the Oregon CCH responses to help arresting and fingerprinting staff
determine whether they need to submit only an Oregon fingerprint card or both Oregon and FBI
cards. An inquiry prior to fingerprinting will indicate which cards need to be submitted.
Occasionally, the FBI will receive a fingerprint card that has poor quality prints. In this case, the
FBI will send a message, via LEDS, that sets a flag in the Oregon CCH record to indicate another
FBI fingerprint card must be submitted, along with the Oregon fingerprint card, when that subject
is “re-arrested”. See Section 19.4.4 for flag message examples.
19.2.2 INTERSTATE IDENTIFICATION INDEX (NCIC-III)
When an arrest fingerprint card is received by the FBI Identification Division from a State
Identification Bureau or a Federal agency, a new or updated record is established in the Interstate
Identification Index (III). This is an automated file which resides on the NCIC computer and which
is accessible by all criminal justice agencies in the country.
The index does not contain the actual criminal record of the individual. It contains personal
descriptive information and an indication of the source of the record(s). A III (“Triple I”) record may
point to one or more sources as described below.
(1) State Criminal History Files If a state system has taken responsibility for its state’s
criminal record on the individual, there will be an entry in the Index pointing to that state.
If the individual is a multi-state offender, the Index will contain pointers to several states
and/or federal agencies.
(2) Federal Offender File If the individual is a Federal offender, the Index will contain a
pointer to the Federal Offender File maintained in the NCIC system, in addition to
pointers to other sources.
(3) Automated Identification System (AIS) AIS is a computer system maintained by the FBI
Identification Division. It contains the complete records of all persons arrested and
reported to the FBI with a date of birth of 1956 or later, or arrested for the first time and
reported to the FBI since July, 1974 regardless of year of birth. Some records are also
maintained on first offenders from 1973 and early 1974, as well as selected manual
records that have been converted to the automated system.
If a record meets the above criteria, and responsibility for the record has not been
assumed by the state(s), the Index record will point to AIS as the source of the criminal
history. As the states assume responsibility for more records, the number of records
pointing to the AIS system will decrease.

A criminal history inquiry by name will result in a response from the Oregon CCH File and
responses from III pointing to one or more states, the Federal Offender File and/or AIS. A
subsequent inquiry to the Oregon CCH System by State Identification Number (SID) will retrieve
the entire Oregon CCH record. An inquiry by FBI number to the Interstate Identification Index will
result in a response from each participating state, the Federal Offender File, and/or AIS, each
providing the information for which it is responsible.

NOTE: Not all states participate in the III program. A “No Record” response does not eliminate
the possibility of records existing in non-participating states. A separate inquiry directly to each of
the non-participating states is necessary to conduct a complete check.
19.3 OTHER STATE CRIMINAL HISTORY RECORDS
For several years, there will continue to be states which are not participating in the NCIC III
program. Since there is no national file or index for these states’ records it will be necessary to
send an inquiry message via NLETS directly to the Identification Bureau of the non-participating
state when there is a reason to believe the individual of interest may have a record in that state.
Special message keys and NLETS routing codes have been developed for this purpose (see
Section 19.7).
19.4 CRIMINAL HISTORY RECORD POLICIES
19.4.1 ACCESS AND DISSEMINATION
Computerized Criminal Histories are available to criminal justice agencies and authorized non-
criminal justice agencies via LEDS from the Oregon State Police CJIS Division Criminal History
Files.
All agencies accessing Oregon files must have a signed agreement with the Oregon State Police
and must adhere to Administrative Rules (Chapter 257, 10-010 through 10-050) adopted by the
Department of State Police.
Section 10-025 of the rules states in part:
(1) Access to CCH information by means of terminals shall be limited to criminal justice
agencies.
(2) A criminal justice agency shall obtain CCH information only in situations in which it is
required by that agency for purposes of fulfilling its legal responsibilities. All inquiries to
CCH shall be based on a valid reason to obtain the information.
(3) Inquiries for nonofficial purposes or the checking of records for persons or agencies
outside the criminal justice community are prohibited.
Oregon Criminal History records fall under the Oregon Public Records Law. Individuals wanting
copies of Oregon Criminal History records pertaining to anyone, other than themselves,
maintained by the Oregon State, may obtain copies of such records by contacting the Criminal
Justice Information Services (CJIS) Division of the Oregon State Police. There is a fee for these
records and the person on whom the information is requested will be notified if there is a
reportable record. However, the person cannot prevent the release of such records provided all
entries contained therein are accurate. Refer to ORS 181.55, 181.560 and OAR Chapter 257,
Division 10-025 for the specific laws and rules.

19.4.2 REVIEW AND CHALLENGE OF CCH RECORDS
Inquiries for review or challenge of records are strictly prohibited. If an individual wishes to review,
challenge, or has questions about their own record they must contact the Criminal Justice
Information Services (CJIS) Division of the Oregon Department of State Police, as set forth in the
provisions of Oregon Administrative Rules, Chapter 257, Section 10-035. NO ONE except criminal
justice personnel, or other persons designated by law, who are acting in their official capacity, for
AN AUTHORIZED PURPOSE, may view criminal history records.
19.4.3 LOGGING OF INQUIRIES
United States Department of Justice Regulations, Title 28, Chapter 1, 20.20 require that records
be maintained to provide for an audit trail of the dissemination of criminal history record
information. All criminal history inquiries are logged by LEDS and NCIC. These log records include
the elements of the inquiry, date, time, terminal identifier, the terminal operator’s initials, and the
name or identifier of the person who requested the inquiry.
These log records can be used for criminal investigations, as well as for internal investigations
where system misuse and/or abuse are alleged.
Secondary dissemination, the dissemination of a criminal history record(s) run using your
agency’s ORI, to ANY other agency or person, is not allowed. CCH inquiries run for other
agencies must always be made using the ORI of the requesting agency and the appropriate
purpose code.

19.5 LEDS AND NCIC CRIMINAL HISTORY INQUIRIES
Computerized criminal history inquiries can be made in two basic ways. If the State Identification
Number (SID) or FBI number is known, the record can be retrieved directly. If the SID and/or FBI
number is not known then an inquiry can be made using the name and the date of birth or some
other numeric identifier.
19.5.1 MESSAGE KEYS
The following message keys may be used in Oregon CCH or NCIC-III inquiries:

19.5.2 PURPOSE OF INQUIRY
Each criminal history inquiry must include a code indicating the purpose of the inquiry. These
codes and their descriptions are shown on the following page. Also, certain purposes which are
valid for accessing the Oregon CCH system are not valid for accessing the NCIC-III system or
systems in other states.

provisions of Oregon Administrative Rules, Chapter 257-010-0035.

PURPOSE CODES
Used for official duties in connection with the administration of criminal justice.
The term “administration of criminal justice” is defined as the performance of any of the
following activities: detection, apprehension, detention, pretrial release, prosecution,
adjudication, correctional supervision, or rehabilitation of accused persons or criminal
offenders.
Purpose code C may also be used in situations that are not part of a criminal justice
investigation but are duties of the agency where a criminal check is necessary to accomplish
the agency’s mission. For example:
1. The security of the criminal justice facility
(a) Vendors or contractors at the criminal justice agency who are NOT involved with
the actual administration of criminal justice at the criminal justice agency, e.g. carpet
cleaner, individuals responsible for maintaining vending machines, janitors, cooks, etc.
C Criminal Justice (b) Volunteers at the criminal justice agencies who are NOT involved with the actual
administration of criminal justice at the criminal justice agency, e.g. participants in
community ride-along programs, volunteers at a confinement facility who are providing
social or community services rather than rehabilitative services etc.
(c) Confinement facility visitors.
(d) Inmates of a confinement facility.
(e) Inmate mail – a prisoner’s list of names and addresses of those wishing to
correspond with the prisoner. (III may be used when there is reason to believe that
criminal activity is occurring or has occurred)
2. A domestic violence investigation conducted by a law enforcement agency. (This III inquiry
is in reference to agency use only. Purpose code D below provides information on court-related
inquiries)
Used when the III transaction involves employment with a criminal justice agency or the
screening of employees of other agencies over which the criminal justice agency maintains
management control. Criminal justice employment has been separated from other criminal
justice purposes due to the requirement of some state agencies participating in III. For those
states that are unable to provide a record for a purpose code J inquiry (i.e. state statute), the
FBI will provide the record on-line.
Criminal Justice This code is used to initiate background checks of agency personnel as well as the following:
J Employment
1. Vendors or contractors at the criminal justice agency who are ARE involved with the actual
administration of criminal justice at the criminal justice agency, e.g. personnel involved with the
maintenance of computer systems, upgrading records system, data entry clerk, etc.
2. Volunteers at the criminal justice agency who are ARE involved with the actual
administration of criminal justice at the criminal justice agency, e.g. volunteer dispatcher,
volunteer data entry clerk, volunteers at a confinement facility who are providing inmate
rehabilitation etc.
Used when the III transaction involves weapons-related background checks authorized by state
law or regulation, including when criminal justice agencies issue firearms or explosives related

permits, and when releasing firearms that have come into law enforcement possession. All
background checks for firearms sales are conducted by the Oregon State Police (OSP)
Firearms unit per statute.

D and Stalking
2. Law enforcement agencies providing a III record to criminal or civil court for a domestic

Used when the III inquiry is made under the authority of the Housing Opportunity Extension Act
H Housing
of 1996. Limited to QH inquiries.
Used when the authorized participating state agency generates an III for internal review.
Administrative File Responses for this purpose code may not be disseminated for any other reason. Responses
A Maintenance are limited to that state’s portion of the record maintained by the FBI. No federal arrest data are
reported. OSP CJIS Division is the only authorized state agency.
Used when the III transaction is generated by an agency authorized by the Security Clearance
Information Act (SCIA) in investigation of individuals for access to classified information or
S National Security
assignment in sensitive national security duties. Limited to an ORI not starting with OR0,
ORD0A, ORDI, ORSP or ORVA.
Used when the III transaction is made for the purpose of determining eligibility for visa
V Visa Applicants application. Limited to QH inquiries by the Department of State, Consolidated Immigrant
Processing Visa Center. (Any Oregon ORI beginning with ORINS or any out-of-state ORI)
This code is to be used when an inquiry is being made by a criminal justice agency into the
background of an individual who has applied to be an employee or agent of a non-criminal
justice agency. Examples are: Employees, contractors, volunteers, block-home parents, foster
parents, etc. Such an inquiry may be made only when the criminal justice agency has written
policy documenting its specific legal and official responsibility for such background
Non-Criminal Justice investigations.
E Agency Employment Purpose code “E” is valid for Oregon CCH inquiries only. Information in a criminal record
may not be shared with the non-criminal justice agency. Typically, the criminal justice agency
will recommend approval or denial, based upon the criminal record check and other elements
of the background investigation. Depending upon the circumstances, the criminal justice
agency may refer the non-criminal justice agency to the Oregon State Police CJIS Division, in
Salem, where the public criminal history record may be obtained for a fee.
This code is to be used when an inquiry is being made into the background of a license or
permit applicant.
Examples are: Foster care provider background checks, OLCC licensing, card room licensing,
L Licensing taxi licenses, explosives licenses, etc. Such an inquiry may be made only when there exists a
specific state or federal statute or local ordinance requiring an investigation into past criminal
conduct as a condition of obtaining the license or permit. Purpose code “L” is valid for
Oregon CCH inquiries only.
Emergency Used by specific agencies to determine the fitness of a person to assume temporary custody of
placement of children a child(ren) in an emergency situation where sufficient time is not available to process the
X in exigent applicant through normal channels. Limited to any ORI Ending in “T”
circumstances
Used only by prosecuting agencies when providing a copy of a convicted offender’s criminal
O Other history to the victim of the crime
To be utilized when a specific agreement is executed between qualified persons and the OSP;
the agreement will state the scope of the project, the permissible dissemination of information.
R Research
Refer to OAR 257-010-0030 for complete details. This purpose code will only return Oregon
records.
19.5.3 OPERATOR INITIALS
The initials of the person operating the terminal must be entered immediately after the message
key in the field shown as XXX in the examples in the following sections.
19.5.4 ORI – ORIGINATING AGENCY IDENTIFIER
The ORI entered in the inquiry must be the ORI of the agency requesting the inquiry. For example,
if an officer of the Baker City Police Department requests a record check via the terminal in his
office then the Baker Police Department ORI would be used. If the request is made by another
agency (e.g., Baker County D.A.) then that agency’s ORI must be used.

19.5.5 REQUESTER IDENTIFIER
Each criminal history inquiry must identify the individual requesting the record. This may be the
requester’s name or a unique identifier such as the DPSST number of a police officer, assistant
district attorney, judge, parole officer or other authorized individual who is requesting the inquiry. If
a title is used in conjunction with the requester’s name, a first name or initial should be used. DO
NOT INCLUDE THE REASON FOR THE REQUEST IN THIS FIELD. The purpose of this field is
to identify the person requesting the information.
19.5.6 CCH NAME INQUIRIES
An inquiry by name and date of birth (or other identifiers) will check Oregon CCH and NCIC-III.
Response to a name inquiry may be a “NO RECORD” from one or both, or the identification
segments of one or more records meeting the inquiry criteria.
If a subject refuses to give a name and/or DOB, but you have found a Social Security Number
written down on some paper in the subject’s possession, you can still run an inquiry based on the
Social Security number (SOC) and/or Miscellaneous Number (MNU). Because the name (NAM)
field is required for all inquiries, you would just show the last name of “XXX” and the first of
“YYY”. Since a DOB is required for all inquiries a fake DOB must also be used.
You can use any letter combination you choose for the name, however, it should be something
extremely unique that would probably never be used as a name. This will substantially reduce the
possibility of receiving multiple near hits based upon the name.

If a person’s FBI number is known, from past contact or from a “QH” inquiry, an inquiry can be
made directly to the NCIC-III system for a detailed criminal history. The NCIC- III system will
respond with one of two types of messages:
1. A response indicating that the FBI number is not indexed in the NCIC- III system. The
record will have to be requested from the FBI Identification Division by teletype or by mail.
2. A response indicating that the inquiry has matched an NCIC- III index record and that the

19.7 REQUEST FOR OUT OF STATE CRIMINAL HISTORY RECORDS NOT IN NCIC III
The National Law Enforcement Telecommunications System (NLETS) supports three special
inquiry transactions which may be used to send a criminal history inquiry directly to another state.
These standard formats allow states which have automated criminal history records systems to
respond automatically, rather than manually.
19.7.1 MESSAGE KEYS
The message keys used for state-to-state criminal history inquiries via NLETS are as follows:
IQ Identification Inquiry. Allows inquiry by NAM & DOB, SOC, MNU, & RAC, etc.
to determine if the subject of the inquiry is contained in the computerized
criminal history file of the destination state.
FQ Record Inquiry. Uses the State Identification Number (SID) to retrieve the
record from the destination state’s computerized criminal history file.
AQ Free Text Criminal History Inquiry Message. This message key is used to
send a free-text inquiry, relating to a criminal record, to the Identification
Bureau or any other criminal justice agency in another state. The use of a
special message key for this purpose is to allow the control terminal agency
in the originating state (LEDS in Oregon) to ensure an agency requesting
criminal history information from another state is authorized to receive it.
AR Criminal History Response. This message key is used to reply to an “AQ”
transaction.

19.8 (IQ) IDENTIFICATION INQUIRY FORMAT
“IQ” inquiries may be sent up to five states in a single transaction, using the standard two
character state codes.
Inquiries may be made using NAM and DOB, NAM AND SOC, or NAM AND MNU. If NAM and
DOB are used, SEX is required and RAC is optional. All inquiries must contain a purpose code
(PUR) and a requester name (ATN).

19.9 (AQ) FREE TEXT CRIMINAL HISTORY INQUIRY
The purpose of the “AQ” inquiry is to request supplemental information or other criminal history
information not available through NCIC-III, or the “IQ” / “FQ” inquiries. This includes requests for
mailed records, photos, fingerprint cards, special request handling, inquiries with limited
information, etc. This inquiry may also be used to request criminal history information from an
agency in another state other than the State Identification Bureau.
“AQ” inquiries requesting rap sheets or other criminal information from the FBI Bureau of
Identification should be addressed to: DCFBIWAD2.
Although an “AQ” message can be addressed to either multiple two character state codes or to
multiple nine character ORI’s, only one subject name per message is allowed. “AQ” messages
should not be used when adequate information is available for an “IQ” / “FQ” inquiry.
When using the “AQ” message key, include personal descriptors of the subject such as name,
sex, race, approximate age or date of birth, etc., as well as other relevant data available. If a
mailed response is anticipated, use a complete mailing address.
If sending the message to a State Identification Bureau, use the standard addressing format for
state ID bureaus, as shown in the examples below.

The format of the “AQ” inquiry is the same as the “AM”, with the addition of a “PURPOSE (PUR)”
field and a “REQUESTER FIELD (ATN)”. See Section 19.5.2 for purpose codes. A maximum of 5

An optional method of obtaining an FBI criminal record may be initiated when a felony warrant is
entered into NCIC.
If a warrant entry contains an FBI number, the entering agency may obtain a copy of the subject’s

The LKI and LKA cannot match the ORI and OCA in the same message. The LKI and LKA must
be entered, modified, or deleted together, as a set.
The characters permitted in LKA are letters, numbers, hyphens, and spaces (same as OCA).
The capability to link records is useful when two or more agencies share the same case, or when
different cases in the same department are associated. When a record is hit by a query using the
RSH/Y option, all records related to it will also be returned. Related records are those with ORI
and OCA matching the hit record's LKI and LKA or ORI and OCA. (For clarification, see Query
section examples.)
It is strongly recommended that agencies assign unique case numbers to records entered under

The first two characters must be a valid NCIC code from the Personal Descriptors chapter of the
NCIC 2000 Code Manual. The third character must be a hyphen. Entry of only zeros is prohibited
in positions 4 through 15.
If the MNU exceeds 15 characters, the leftmost 15 characters should be entered in the MNU field.
The full MNU should then be entered in the MIS Field.
19.18.69 MON MONIKER – 30
OPTIONAL
To give Oregon agencies the ability to add “street” names, nicknames, etc. LEDS added a
“moniker” (MON) field to all Oregon person records. This information is not stored in NCIC
records. This field is unique in that it does not exist in the base record. Therefore, the
supplemental transaction is the way to add this information to the record. A maximum number of 9
monikers may be added to any one record. This field only accepts alpha characters and hyphens (
- ). If the street name of the subject is 8 ball, it would be entered as “eight ball”.

hyphen with a space. If that creates more names than permitted, remove the space so the two
formerly hyphenated names become one.

A unique OSP-assigned number for all persons with a fingerprint-based state identification record,
including Oregon criminal history records. It has a check digit. When included in a wanted person
record it may be hit by a subsequent query.
The SID is also used by enhanced data entry. When included in a wanted person entry message,
without any other personal identifiers, it is used to retrieve personal identifiers from the fingerprint-

based state identification record. That data, in addition to items necessary for a new record, is
used to create a new wanted person record.

o The first four characters must be a valid code
If the VMA code is less than four characters and data are included in positions 5 through 24,
positions 3 and/or 4 must be blank.
o The remaining characters are free text and must contain the name of the manufacturer
when the VMA code is AERO, ATV, COEQ, CYL, FARM, SNOW, SPEC, TRLR, or
TRUK.

maximum is 499. A leading zero is required when the weight is less than one hundred pounds.
Three zeros ("000") may be used with RW and SW messages when the weight is unknown.

Mandatory for EW, EWJ, SW, and RW.
A court issued number. Letters, numbers and hyphens allowed. Hyphens are removed from the
