18.0 PROTECTION ORDER FILE
18.1 FILE DESCRIPTION
The Protection Order File contains court orders that are issued to prevent acts of domestic violence
against a person or to prevent a person from stalking, intimidating, or harassing another person. Both
civil and criminal state courts issue orders.
The LEDS and NCIC Protection Order File provides an index to all individuals who are restrained
from making contact with specified persons and/or appearing in specified locations.
18.1.1 TYPES OF ORDERS
Protection Order records consist of Restraining, Sexual Abuse Protection, Court’s Stalking Protection,
pre-trial release No Contact, Emergency Protection, Extreme Risk, and Temporary Protection Orders.
Information contained in each record includes the name and identifying information of such persons.
Each record also indicates which county sheriff's office holds the original order.
18.1.1.1 RESTRAINING ORDERS
ORS 107.718 states, in part, that when a person files a petition under ORS 107.710, the circuit court
shall hold a hearing within specified time limits. Upon showing that the petitioner (victim) has been the
victim of abuse committed by the subject (suspect) within 180 days preceding the filing of the petition,
and that there is an immediate and present danger to the petitioner, the court shall, if requested,
order, for a period of one year or until the order is withdrawn or amended, or until the order is
superseded as provided in ORS 107.722, issue an order that, among other things, restrains the
suspect from varying degrees of contact with the victim and/or members of the victim's family.
18.1.1.1.1 SEXUAL ABUSE PROTECTION ORDERS
Sexual Abuse Protection Orders (SAPO) are protective orders issued by the Court to prevent sexual
abuse. See ORS 163.760 – 163.777.
Sexual Abuse Protection Orders shall be entered into LEDS using the Enter Protective Order
transaction with the RTP code “RPO,” and include a note in the MIS field noting the order is a Sexual
Abuse Protection Order.
18.1.1.2 COURT’S STALKING PROTECTION ORDER
Pursuant to ORS 163.738, the court may issue a Temporary Stalking Protective Order pending
further proceedings, or, if the court finds by a preponderance of the evidence, that the person
intentionally, knowingly, or recklessly engages in repeated and unwanted contact with the other
person or a member of that person's immediate family or household thereby alarming or coercing the
other person, the court may issue a Court's Stalking Protection Order restraining the stalker from
having any contact with the victim. The Court's Stalking Protection Order may be for an unlimited
duration of time, unless limited by law [refer to ORS 163.738 (2)(b)].

18.1.1.3 PRE-TRIAL RELEASE NO CONTACT ORDER
In the State’s General Conditions of Release Agreements, ORS 135.250 states that the court shall
include non-contact with the victim as a release condition if the person was charged with a domestic
violence offense. Additionally, it states that ORS 107.720 (Sheriff’s Enforcement of Restraining
Orders) applies to no contact release agreements executed based on domestic violence charges, that
proof of service is not required, and that the agreement may not be terminated at the request of the
victim without a court hearing. ORS 107.720 requires the county sheriff to enter these orders forthwith
into LEDS and NCIC, and states the order will remain in effect until the expiration date or when
terminated by the court.
18.1.1.4 TEMPORARY RESTRAINING ORDERS (TPO)
A Temporary Restraining Order (TRO) may be issued for a short term by the court. A TRO usually
lasts while a motion for preliminary injunction is being decided, and the court decides whether to drop
the order or to issue a Restraining Order. A Temporary Restraining Order is granted in ex parte
situations, that is, without informing in advance the party to whom the temporary restraining order is
directed. Oregon is an ex parte state. The TRO is granted to prevent the subject/respondent from
acting to in an adverse way towards parties protected by the protective order.
When entering a TRO into LEDS, keep in mind that the order does not have an expiration date but
should be removed upon receiving more information from the court. The TRO should be removed as
the protective order will either be entered as a Restraining Order (no longer temporary) or the order
will have been dropped during the due process procedures.
The Temporary Restraining Order is added in the Protection Order Mask (EPO) under Report Type
(RTP) as code TPO.
18.1.1.5 EMERGENCY PROTECTION ORDER (POE)
Effective 1 January 2016 and pursuant to 2015 HB 2776, law enforcement officers may apply for an
Emergency Protection Order (POE), which will restrain domestic abusers from contacting their victim
for seven days. Emergency Protection Orders are not intended to replace other types of Protection
Orders, but grants protection to the victim while giving them time to apply for a traditional Protection
Order. Unlike other types of Protection Orders, Emergency Protection Orders can be entered into
LEDS by any law enforcement agency (not only Sheriff’s Offices).
When entering a POE into LEDS, the only applicable PCO code is PC10. The order is valid for seven
(7) days after being granted. All Emergency Protection Orders must be entered as Brady: No
(BRD/N). These orders are enforceable within Oregon only and are not forwarded to NCIC.
The Emergency Protection Order is added in the Protection Order Mask (EPO) under Report Type
(RTP) as code POE.
18.1.1.6 EXTREME RISK PROTECTION ORDER (ERP)
Effective 1 January 2018 and pursuant to 2017 SB 719, Oregon courts may issue an “Extreme Risk
Protection Order.” This order will require the respondent to surrender all deadly weapons in their
custody, control, or possession, as well as to surrender any Concealed Handgun License (CHL), to
local law enforcement. Further, the respondent will be prohibited from purchasing, possession,
receiving, or attempting to purchase or receive any deadly weapons while the order is in effect.

Extreme Risk Protection Orders are valid for one year from the date of issue or until the order is
terminated, whichever is sooner. These orders are valid in Oregon only; Extreme Risk Protection
Orders are entered into LEDS but will not be forwarded to NCIC.
The Extreme Risk Protection Order is entered via the “Enter Protection Order” (EPO) transaction
using the Report Type (RTP) code ERP.
18.1.1.7 PETITIONER NOTIFICATION PROCESS (ENAD)
The Family Abuse Prevention Act (FAPA) Notification Project will automatically notify petitioners
when their protection order has been served and send them a notification 30 days prior to their
protection order expiration date. This optional notification is provided for those petitioners who
voluntarily fill out the Enhanced Data Confidential Information Form (CIF) which is separate from the
restraining order CIF as the enhanced version includes relevant email and cell phone information.
Once this enhanced data has been entered into LEDS by the Sheriff’s Office (through an ENAD
LEDS transaction), it will automatically trigger an email and/or cell phone text message to the
petitioner that the protective order has been served. Additionally, when the expiration date of a
protective order has been modified via an MPO LEDS transaction (specifically when the order has
been renewed prior to expiration and is updated by the Sheriff’s Office in LEDS) the petitioner will
receive an email and/or text message notification.
This is an optional service designed to provide the petitioner with information relevant to their safety
and the status of their protective order in a timely manner.
Please note the delivery of the message is not guaranteed and is considered an optional addition to
the existing requirement under ORS107.720 which states, “The Sheriff shall also provide the
petitioner with a true copy of the proof of service.”
In addition, if there is a change to their email address or cellular phone or cellular provider, the
petitioner must notify the sheriff of such a change so that the record can be updated for future
notifications.
18.1.1.8 FOREIGN PROTECTION ORDER
Pursuant to ORS 24.190, protective orders issued by out-of-state courts are enforceable in Oregon
immediately upon the protected person’s arrival in this state and shall continue to be so treated
without any further action by the protected person. The protected person may choose to register the
order with the court or have the order entered into LEDS but they are not required to do so as a
condition of enforceability.
Oregon Sheriff’s Offices are required to enter the order into LEDS/NCIC if the petitioner requests
entry and meets the following:
• Provides a true copy of the order; and
• Certifies the order in hand is the most recent copy; and
• The petitioner verifies the subject has been served or received actual notice.
18.1.1.9 MANDATORY ENTRY OF PROTECTION ORDERS INTO LEDS
Included in each of the above-mentioned statutes is language requiring the sheriff's office, having
jurisdiction in the county where the order is SERVED upon the suspect, to immediately enter the
Restraining or Stalking Protective Order into the LEDS database.

Emergency Protection Orders shall be immediately entered into LEDS by the originating law
enforcement agency, after the order has been served upon the Respondent.
18.2 AUTHORIZED SYSTEM USE
The LEDS, NCIC, and other databases are designed for, and made available to, criminal justice
agencies to aid in the investigation of crimes and prosecution of criminal offenses.
In addition, under certain conditions, select governmental non-criminal justice agencies are granted
limited access via specific authority set forth in law, rule, and/or executive order necessary to fulfill
very specific duties of given agency.
Notwithstanding this exception, use of the system as well as all the data entered into or extracted
from any such database(s) is restricted to a Criminal Justice Purpose and the “administration of
criminal justice” which is defined as:
“The performance of any of the following activities: detection, apprehension, detention, pre-trial
release, post-trial release, prosecution, adjudication, correctional supervision, or rehabilitation of
accused persons or criminal offenders.”
The administration of criminal justice shall include criminal identification activities and the collection,
storage, and dissemination of criminal history record information. Criminal justice employment
investigations are included, as is the licensing or issuing of a permit for a weapon or explosive when
required to be performed by a criminal justice agency, pursuant to a federal, state, or local law. (This
category includes firearms dealers and purchasers, carriers of concealed weapons, explosives
dealers and users and lethal weapons dealers and users). State and Federal Inspector General
Offices are included.
Defense of accused persons, whether by private counsel, public defender or other court appointed
counsel is not included in the definition of the administration of criminal justice.
LEDS and NCIC conduct both routine and unscheduled audits to ensure strict adherence to system
discipline. LEDS is mandated to investigate all reports of violations of system use policies, physical
and technical security, as well as data access, use, and dissemination policies and procedures.
18.3 RECORD RETENTION

until the order expires. Five days prior to an order's expiration date, an unsolicited $.P. administrative
message will be sent by NCIC to the ORI of record. This message will serve to notify the agency of
the order's impending expiration date (EXP). It also serves to remind the agency that the record will
have to be modified if the EXP is changed by the court.

18.4 TIMELINESS OF ENTRY
Entry is to be made immediately after the suspect/subject has been served and/or otherwise notified
of the order in a means compliant with the procedures set forth in Oregon Revised Statute and all
other conditions for entry are met. The promptness in entering, modifying, and canceling of protective
orders is the responsibility of the originating agency. All entries must be checked by a second
party to assure accuracy of the information contained in the entry.
Timely modification of a record is that which occurs as soon as possible following the detection of
erroneous data in an existing record, and/or as soon as possible following the receipt of data not
already stored in the record.
Timely removal from the file requires immediate removal of the record once the originating agency
has documentation that the order has been rescinded or is no longer valid.
18.5 RECORD COMPLETENESS – GENERAL
Before entering a Protective Order, it is imperative to obtain as much information as possible. It is the
sole responsibility of the entering agency to ensure all sources of available information are checked.
Sources include, but are not limited to:
• State and National Computerized Criminal History Files
• Agency case files
• Vehicle Registration records (cars, boats, aircraft, etc.) in and out of state

• Social security number, as well as AKA SSNs
• FBI number,
• State Identification Number (SID),
• Driver’s license number, as well as AKA OLNs

• Scars, marks, tattoos, medical conditions

18.5.1 RECORD COMPLETENESS – CAUTION INDICATORS
The caution indicator "C" may be used as part of a Protection Order message key. The caution may
be for officer safety, or for the health and safety of the subject, for example, if the person has a life
threatening medical condition. If used, the appropriate code must be entered into the Cautions and
Medical Conditions (CMC) field and a plain-text explanation entered into the Miscellaneous (MIS)
field.
18.5.2 RECORD COMPLETENESS – MISCELLANEOUS FIELD (MIS)
At minimum, agencies must enter a telephone number at which they may be reached 24-hours a day
for confirmation purposes.
MIS must include explanatory information when any of the following conditions are met:
• A caution indicator is placed on the record
• The Protection Order Code (PCO) is “08”
• An entry is made in the “Cautions and Medical Conditions” (CMC) field
• Only the last 20 characters fit in the VIN field – (enter the complete VIN in the MIS field)
• Only the last 10 characters fit in the LIC field – (enter the complete LIC in the MIS field)
• Only the last 15 characters fit in the MNU field – (enter the complete MNU in the MIS)
• When entering a test record – (enter "TEST RECORD ONLY" as the first entry in the MIS
Field)
18.5.3 RECORD COMPLETENESS – OPERATOR LICENSE NUMBER (OLN)
The entry of the subject’s driver license information into the LEDS and NCIC files provides additional
identification data. If the subject’s driver license is an Oregon issued document, LEDS will determine
whether or not it is an existing Oregon OLN.
If it is an existing Oregon OLN, LEDS will add the DMV address information to the LEDS record.
LEDS will recheck the DMV records whenever the LEDS record is modified and update the LEDS
files appropriately. If changes have occurred to the address information held in the DMV record then
LEDS will also send an unsolicited message to those agencies with records containing the OLN.

The entry of protected person address information into the LEDS file will assist in determining if the
subject is in violation of the protection order conditions. Information can be entered for Home, Work,
School, Mailing, and an Other address for each and every protected person named in the protection
order.

The entry of address information for the subject may assist in locating the subject if a violation of a
protection order is reported. Information can be entered for Home, Work, School, Mailing, and an

18.5.6 RECORD COMPLETENESS – VEHICLE INFORMATION
The entry of vehicle information into the LEDS and NCIC files is critical for officer safety reasons. A
vehicle and/or license plate may be entered as part of a subject record provided the location of the
vehicle and/or license plate is unknown and the entering agency has reasonable grounds to believe
the subject may be utilizing the vehicle, or a vehicle bearing the license plate.
MERE KNOWLEDGE THAT A VEHICLE AND/OR LICENSE PLATE IS REGISTERED TO THE
SUBJECT DOES NOT MEET THE CRITERIA FOR ENTRY OF EITHER OR BOTH AS PART OF
THE PROTECTION ORDER FILE RECORD.
INVESTIGATORS MUST HAVE REASONABLE GROUNDS TO BELIEVE THAT THE SUBJECT
OF THE PROTECTION ORDER IS ACTUALLY OPERATING, OR A PASSENGER IN, THE
VEHICLE, OR A VEHICLE BEARING THE LICENSE PLATE.
In instances where the vehicle or license plate in a protection order entry has been stolen, a notation
that the vehicle or license plate is stolen should be placed in the miscellaneous field of the protection
order file record.
Also, a separate entry of the stolen vehicle, felony vehicle, or license plate should be made in the
stolen vehicle or license plate file by the agency possessing the theft report or handling the felony
investigation.
18.5.7 RECORD COMPLETENESS – BRADY INDICATOR
Protection orders meeting certain criteria disqualify an individual from possessing, purchasing, or
receiving a firearm per Title 18 United States Code (USC), Section 922 (g)(8). The Brady Indicator
(BRD) field indicates whether the subject of the order is disqualified from possessing a firearm under
federal law. To complete the BRD field, users must answer the question: Does the protection order
meet federal prohibiting criteria? Acceptable answers are: “Y” for yes, “N” for No, or “U” for
unknown/unable to determine.
For a protection order to disqualify a person from possessing a firearm under federal law, the
following four conditions must be met:
Relationship – the protected person is a spouse or former spouse of the subject, the parent of
subject’s child, a person does or did cohabit (live in a sexually intimate relationship), spouse/former
spouse, parent of subject’s child or cohabitant/former cohabitant).
Notice and Opportunity to Participate – the order was issued after a hearing of which the subject
received actual notice and at which subject had the opportunity to participate.
Restrains from Future Conduct – the order restrains subject from harassing, stalking or threatening
the petitioner’s or subject’s child/ren or engaging in conduct that would place petitioner in reasonable
fear of bodily injury to petitioner or petitioner’s child/ren: AND
Credible Threat – the order includes a finding that the subject represents a credible threat to the
physical safety of the petitioner or petitioner’s or subject’s child/ren; OR

Prohibits Physical Force – the order explicitly prohibits the use, attempted use, or threatened use of
physical safety of the petitioner or petitioner’s or subject’s child/ren that would be reasonable
expected to cause bodily injury.
If the criteria are met, Y should be entered in the BRD Field.
Temporary orders and Emergency orders (issued ex parte) do not meet the criteria specified by
federal law and therefore, N must be entered in the field.
Prior to entering the record, an entering agency should make every attempt to determine the firearm
disqualification status. The federal firearm prohibition does not apply unless the relationship between
the subject of a protection order and the protected person (petitioner) is that an intimate partner or
child of an intimate partner.
Intimate Partner--with respect to a person, the spouse of the person, a former spouse of the person,
an individual who is a parent of a child of the person, child of the subject, and an individual who
cohabitates or has cohabitated with the person.
Cohabitation—requires a live-in relationship (or former live-in relationship) between the two (2)
individuals (can be same sex) which, in essence, is a sexual/romantic relationship, NOT merely a
roommate.
Ex-Parte – “on one side only; by or for one party; done for, in behalf of, or on the application of, one
party only. A judicial proceeding, order, injunction, etc., is said to be ex parte when it is taken or
granted at the instance and for the benefit of one party only, and without notice to, or contestation by,
a person adversely interested.

18.5.8 RECORD COMPLETENESS – ORS 135.250
135.250 General conditions of release agreement.
1. If a defendant is released before judgment, the conditions of the release agreement
shall be that the defendant will:
(a) Appear to answer the charge in the court having jurisdiction on a day certain and
thereafter as ordered by the court until the defendant is discharged or the judgment is
entered;
(b) Submit to the orders and process of the court;
(c) Not depart this state without leave of the court; and
(d) Comply with such other conditions as the court may impose.
2. (a) In addition to the conditions listed in subsection 1 of this section, if the defendant is
charged with an offense that also constitutes domestic violence, the court shall include
as a condition of the release agreement that the defendant not contact the victim of the
violence.
(b) Notwithstanding paragraph (a) of this subsection, the court may enter an order
waiving the condition that the defendant have no contact with the victim if:
(A) The victim petitions the court for a waiver; and

(B) The court finds, after a hearing on the petition, that waiving the condition is in
the best interests of the parties and the community.
(c) If the defendant was provided notice and an opportunity to be heard, the court shall
also include in the agreement, when appropriate, terms and findings sufficient under 18
U.S.C. 922 (d)(8) and (g)(8) to affect the defendant’s ability to possess firearms and
ammunition or engage in activities involving firearms.
(d) ORS 107.720 applies to release agreements executed by defendants charged with
an offense that constitutes domestic violence, except that proof of service of the release
agreement is not required and the agreement may not be terminated at the request of
the victim without a hearing.
3. If the defendant is released after judgment of conviction, the conditions of the release
agreement shall be that the defendant will:
(a) Duly prosecute the appeal of the defendant as required by ORS 138.005 to 138.500;
(b) Appear at such time and place as the court may direct;
(c) Not depart this state without leave of the court;
(d) Comply with such other conditions as the court may impose; and
(e) If the judgment is affirmed or the judgment is reversed and the cause remanded for a new
trial, immediately appear as required by the trial court. [1973 c.836 §150; 1991 c.111 §10;
1993 c.731 §6; 1999 c.617 §3]
18.6 ACCURACY
The accuracy of records is an integral part of the system. All record entries must be verified by a
second party to ensure accuracy of the information contained therein.
The verification of a record must include assuring all available cross checks, e.g. VIN/LIC, were made
and that the data in the record matches the data in the protection order.
18.7 DUPLICATE RECORDS – MULTIPLE PROTECTION ORDERS
Often the same agency may hold multiple Protection Orders on the same person. There is no limit to
the number of Protection Orders that agencies may enter on the same subject PROVIDED the OCA
and the Protection Order Number(s) are different.

18.8 RECORD VALIDATION
Validations are now handled by the LEDS Representative or designee. The procedures are listed on
LEDS Website under the LEDS Representative Manual, with file name “LEDS Representative,
Section 5, Validations.”
To validate a record, add or modify the Name of Validator Field (VLN) using a modify message. The
Date Last Validated field (VLD) is automatically updated with the current date and time anytime VLN
is modified. The VLN will only be displayed in responses to terminals from the entering agency.

18.10 LNU AND NIC NUMBERS
Unique LEDS and NCIC file numbers are assigned to each record entered. These numbers are
included in the computer acknowledgment of the entry and should be retained in the agency case file
along with a copy of the record entered. No entry transaction is complete until the acknowledgment is
received from LEDS, and from NCIC when applicable.

18.10 LEDS AND NCIC CODES
Only codes listed in the LEDS Manual or the NCIC Code Manual are allowed in protection order
records.

the Message Field Code Directory, in section 18.18.
18.11 ENTRY TRANSACTION
18.11.1 ENTRY TRANSACTION CRITERIA
18.11.1.1 RESTRAINING ORDER ENTRY CRITERIA (ORS 107.720)
County Sheriff’s offices shall enter the Restraining / Protective Order into LEDS upon receipt of:
1. A true copy of the proof of service OR upon receipt of any restraining order which states proof
of service is not necessary, AND
2. A true copy of the Restraining Order
The county sheriff's office having jurisdiction in the county where the subject (restrained person) was
SERVED notice of such order, shall immediately enter the Restraining Order into LEDS.
18.11.1.2 STALKING PROTECTIVE ORDER ENTRY CRITERIA (ORS 163.741)
County Sheriff’s offices shall enter the Stalking / Protective Order into LEDS upon receipt of:
1. A True copy of the proof of service OR upon receipt of any Court's Stalking Protective Order
which states proof of service is not necessary, AND
2. A true copy of the Court's Stalking Protective Order.

The county sheriff's office having jurisdiction in the county where the subject (restrained person) was
SERVED notice of such order, shall immediately enter the Court's Stalking Protective Order into
LEDS.
EXAMPLE:
Multnomah Circuit Court issues a Restraining Order on a subject who resides in Lane County.
Multnomah County routes the order to Lane County S.O. to serve. Lane County cannot locate the
subject but discovers the subject works in Deschutes County. As a result, Lane County sends the
order to Deschutes County for service. Deschutes County locates the subject and serves the order.
It is the responsibility of the Deschutes County Sheriff's Office to enter the Restraining Order
into LEDS under their ORI. However, the ORI for the Multnomah County Circuit Court must be
entered into the CRT field.
18.11.1.3 PRE-TRIAL RELEASE NO CONTACT ORDER ENTRY CRITERIA (ORS 135.250)
County Sheriff’s offices shall enter the pre-trial release No Contact Order into LEDS upon receipt of a
true copy of the No Contact Order issued following the arrest and subsequent release of a person
charged with an offense that constitutes domestic violence.
18.11.2 ENTRY TRANSACTION DESCRIPTION
The Enter Protection Order transaction is used to enter records of persons for whom some type of
protection order (restraining, stalking, pre-trial no contact, etc.) has been issued.
18.11.3 ENTRY TRANSACTION PROCEDURE
An acknowledgment will be received from both LEDS and NCIC.
All acknowledgments must be retained in the case files for documentation

18.11.7.1 SUPPLEMENTAL DATA ENTRY TRANSACTION DESCRIPTION
Supplemental record entries are used to append additional identifiers to a record. Examples of
additional identifiers are alias names, additional protected persons, multiple driver’s licenses, social
security numbers, additional vehicles, etc. This additional information will be appended to the original
entry.
Additional addresses for the subject and/or the protected person(s) can only be added using the
Supplemental Address Entry transaction described in section 18.12.8 below.
18.11.7.2 SUPPLEMENTAL DATA ENTRY TRANSACTION PROCEDURE
A data field in the base record must be filled before any supplemental entry for that same field will be
accepted. For example, any attempt to enter a Social Security number as a supplemental record will
be rejected if the base record does not already contain a Social Security number in the Social
Security number (SOC) field. (See the “MODIFY” Section later in this chapter for complete details on
how to enter information into a field that does not contain data in the base record).
A maximum of nine additional identifiers of various kinds may be entered in one supplemental
transaction. Additional supplemental entry transactions are required if more than nine identifiers are
to be entered.

The entry of vehicle information into the LEDS and NCIC files is critical for officer safety reasons.
The base record must be identified by name, (NAM/) and agency case number (OCA/), as shown in
the example in Section 18.12.7.7.1.
18.11.7.4 SPECIAL INSTRUCTIONS
To enter similar information (e.g., two Social Security Numbers) use the appropriate message field
code and enter like information separated by periods.

The Supplemental Address Entry transaction can append address information, e-mail address,
telephone contact numbers, and cellular telephone numbers, to a person named within a protection
order record. The information consists of address type, street number, street name, city, state, zip,
phone1, phone 2, phone 3, e-mail 1, e-mail 2, cell phone carrier 1, cell phone carrier 2 and cell phone
carrier 3.

18.11.9 SUPPLEMENTAL INVESTIGATIVE INTEREST RECORD
18.11.9.1 SUPPLEMENTAL INVESTIGATIVE INTEREST DESCRIPTION
The Investigative Interest Supplemental Record allows users to indicate an investigative interest in an
existing LEDS and/or NCIC record that belongs to another agency. Up to ten agencies [other than the
Originating Agency] may add an Investigative Interest Supplemental Record to the base record.

This transaction is a departure from the accepted norm that only the ORI of record may modify a
record. This transaction adds a supplemental record indicating the interest of another agency as to
the disposition of the original record.
When an agency places its ORI (IIA) and OCA (ICA) on a record, it will receive notification should that
record be cancelled, cleared, located, modified or purged by another agency. It may also be notified
(depending on the NIA flag) if the record is returned to any agency as a result of a query made by the
inquiring agency. These are all unsolicited messages and are sent to the primary printer designated
for the ORI.
If the record is both LEDS and NCIC qualified, notifications will be received from both LEDS and
NCIC.
Investigative Interest Supplemental Records have the same record retention period as the base
record. At the end of the retention period for the base record, the Investigative Interest Agency (as
determined by IIA) is notified with an administrative message that the record has been purged.
18.11.9.2 IDENTIFICATION OF RECORD TO APPEND INVESTIGATIVE INTEREST
Records that are to have an Investigative Interest Supplemental Record appended must be identified
by:
LNU and OCA in that order for LEDS only records
or
NIC and OCA in that order for NCIC only records
or
LNU, NIC, and OCA in that order for records that are in both LEDS and NCIC

18.12 MODIFY TRANSACTION
18.12.1 MODIFY TRANSACTION DESCRIPTION
The modify transaction is used to add, delete or change data in one or more fields of an existing
wanted person base record.
18.12.2 MODIFY TRANSACTION PROCEDURES
A Protection Order record can only be modified by the agency that made the original entry. Records
must be immediately modified when it is determined that:
• Data contained in the record is incorrect, or
• Additional data has been located that is not included in the record
18.12.2.1 DELETION OF DATA FROM A RECORD
To delete data from a field, enter the message field code followed by a slash and a period. (e.g.
SOC/.)
A special shortened format may be used to delete the entire set of vehicle information from a record
(e.g. LIC-VCO/.) Using this identifier instructs the system to remove all vehicle data in the record,
from license through color.
18.12.2.2 DELETION OF PRIMARY PROTECTED PERSON
Deleting the primary protected person from the record will not cause the next protected person (from
a supplemental record) to be “promoted” to primary. A new primary protected person should be
entered. If this person already exists in a supplemental record then the person must be deleted from
the supplemental record before entering the person as the primary protected person.
18.12.2.3 MODIFYING SUPPLEMENTAL DATA
No one-step procedure is available to modify an alias or other identifier in a supplemental record to a
protection order record.
To modify (change) an alias or other identifier in a supplemental record, the incorrect alias or other
identifier must be deleted, then entered correctly. Deleting a protected person’s name from a
supplemental record will also delete any supplemental address data for that person.

record.

No one-step procedure is available to modify fields in an Investigative Interest Supplemental Record.
To modify, the Investigative Interest Supplemental Record must be cancelled and reentered.
18.12.6 NCIC MESSAGE WHEN THE ORI IS MODIFIED TO THAT OF ANOTHER AGENCY
NCIC will send an unsolicited $.O.MOD.ORI Modify Notification to the new Originating Agency
Identifier (ORI) when the ORI Field in an NCIC record is modified to its agency. Modification of the
ORI field is limited since the ORI of record can modify the ORI Field to another agency’s within its

18.14 CLEAR TRANSACTION DESCRIPTION
The clear transaction is used when a court notifies the owner of the record that the Petitioners Motion
and Affidavit for Dismissal was approved and signed by the Judge. This may be as a result of
petitioner request. A clear transaction would also be used when certification is provided that either
the petitioner or respondent is deceased, for orders with only one protected person. The clear
transaction will change the status of the Protection Order from active to inactive. Clearance of the
Protection Order record is restricted to the agency that entered the record. No Contact Order (NCO)
pretrial release agreements will be cleared if adjudication has completed with a guilty verdict, or the
restrained agrees to a plea agreement resulting in a guilty disposition.
The Clear transaction will result in the cleared Protection Order Record appearing in the NCIC
Historical Protection Order file for five (5) years after the year it has been cleared.

18.15 CANCEL TRANSACTION DESCRIPTION
The cancel transaction is used to cancel the record from the system when the record, for whatever
reason, is no longer valid or when the court notifies the owner of the record by way of Order After
Hearing form, that the record has been cancelled or dismissed and this Order After Hearing has been
signed by the Judge. No Contact Order (NCO) pretrial release agreements will be cancelled if they
are dismissed by the court prior to adjudication, if the District Attorney’s Office decides to not proceed
with charges, if adjudication has completed with a not guilty verdict, or the restrained agrees to a plea
agreement resulting in a not guilty disposition.

18.15.5 CANCEL SUPPLEMENTAL DATA TRANSACTION
Supplemental data can be cancelled from a protection order record without changing the base record.
When canceling supplemental data, each field to be cancelled must be preceded by the appropriate
message field code identifier.
A maximum of nine supplemental identifiers may be cancelled in one transaction.
Each identifier to be cancelled must be preceded by the appropriate Message Field Code (MFC)
identifier.
Base record fields must have data before their supplemental entries are accepted. When data is
deleted from base record fields which have supplemental data fields, the top supplemental data entry
is shifted into the base record. (Exception:- supplemental data sets do not shift, only individual fields
shift into the base record.)
When canceling the following supplemental data, multiple data elements (up to the maximum of nine)
may be cancelled without repeating the Message Field Code (MFC) identifier for like data.

18.16 LOCATE TRANSACTION
Protection Orders cannot be located; they must be cancelled by the entering agency.
18.17 QUERY TRANSACTIONS
Prior to taking any action on a record listed in the system, the investigating agency must, for
liability reasons, confirm the validity of such record with the entering agency.
A wanted person check searches all of the LEDS and NCIC person’s files for warrants and protection
orders. If vehicle data (e.g., VIN, serial number, license information) was entered in the query
transaction, the Vehicle, Stolen Boat, and Vehicle/Boat Parts Files will also be searched.

18.17.2.1 RESPONSE OPTIONS USING THE “INV” MESSAGE FIELD CODE
If not used, record responses are limited to a maximum of 10 abbreviated near hits. If you want to
receive all hits, use the “ALL” option i.e. INV/ALL.
If using the “QLW” message key and you want to receive the full near hit response for the first 10 best
candidate near-hit records, use the “FULL” option i.e. INV/FULL.
Note: If more near-hit records exist, a message will be displayed at the bottom of the response that
indicates more near-hits exist. In this case, you must use the “ALL” option to retrieve such records. It
should be noted that in order to retrieve the complete near hit record, you will need to run a separate
query using the identifiers provided in the abbreviated response.
The “INV” option i.e. INV/INV is no longer functional but will not cause an error – all hits are now
forwarded to corrections. The agency of record will receive an unsolicited message similar to the
following:-
18.17.3 QUERIES WITH UNKNOWN NAMES (DUMMY NAMES)
Although the NAM field is required for all inquiries, if a real name cannot be obtained, any name can
be used as a dummy name, however, it is best to use something like “XXX” for a last name and
“YYY” for a first.
For obvious reasons, not too many people will have a name like YYY XXX, thus the chances of
obtaining an incorrect match or near hit based on the name is remote.

THIS IS NOT AN ARREST WARRANT; Once it is verified the person contacted or arrested is the
subject listed as having a protective order issued against them, AND probable cause exists to believe
the subject violated such order, the contacting or arresting agency must confirm the validity of the no
contact order using the YQ Transaction.

"U" Unknown = the subject is not prohibited under federal law from possessing firearms when
cohabitation cannot be determined. If a judge cannot determine cohabitation, the federal criterion is
not met.
"N" No = the subject is NOT prohibited under federal law from possessing firearms when cohabitation
cannot be determined. If a judge cannot determine cohabitation, the federal criterion is not met.
"Y" Yes = the subject is prohibited under federal law from possessing firearms, i.e. the order meets
the criteria of Title 18 U.S.C. Section 922 (g) (8). A code of Y causes the following caveat to be
displayed within the record:

name part as a last name, interchanging the remaining name parts as given names. For example,

When included in a protection order record it may be hit by a subsequent query. Enter the complete
FBI number including any alphabetic characters.
18.18.24 FPC FINGERPRINT CLASSIFICATION (20)

Must be valid codes as described in the Personal Descriptors chapter of the NCIC 2000 Code
Manual.
If the first character of any finger is numeric, the second character must also be numeric. Codes 00
and 50 may not be used.
18.18.25 HAI HAIR COLOR (3)

The code XXX is used for unknown or completely bald in protection order records. All other codes
must be as listed in the Hair Color (HAI) Field Codes section of the NCIC 2000 Code Manual.
18.18.26 HGT HEIGHT (3)
OPTIONAL
Height in feet and inches, using three digits. Fractions of an inch should be rounded to the nearest
inch. For example, a person 6' 2" tall would be coded as 602.
Approximate height in an inquiry – height plus or minus 3 inches will be searched.
18.18.27 ICA INVESTIGATIVE INTEREST CASE NUMBER (20)

NOTE: If more near-hit records exist, a message will be displayed at the bottom of the response that

18.18.39 MIS MISCELLANEOUS (500)
MANDATORY
At minimum, agencies must enter a telephone number at which they may be reached 24-hours a day
for confirmation purposes. Information in the MIS Field is not searchable.
All characters except period, slash, single quote and double quote permitted. Aliases, vehicle data,
date of birth, Social Security numbers, and operator’s license numbers should not be entered in the
MIS Field. All additional searchable data should be entered as a supplemental record (MKE/EN) as
this procedure increases the changes of a hit on the record.
When an agency enters a Protection Order File record with a protection order condition of 08, the
terms and conditions must be entered in the MIS Field.

This field should be used to further explain the conditions of the order. For example, if the terms and
conditions of the PCO state that the subject is restrained from entering the residence, property,
school, or place of employment of the protected person(s) or of the other family or household
members of the protected person, then such information is shown in the MIS Field. Additionally, the
MIS Field should contain details regarding service of the order.
18.18.40 MKE MESSAGE KEY (4)
MANDATORY
Code indicating the message being processed. The message keys described in this chapter are EII,
EN, ENAD, EPO, EPOC, MPO, XNAD, XII, XN, and XPO.
18.18.41 MNU MISCELLANEOUS NUMBER (15)
OPTIONAL
The first two characters must be a valid MNU code from the Personal Descriptors chapter of the
NCIC 2000 Code Manual. The third character must be a hyphen. The remaining characters must be
letters or numbers. The use of only zeros is prohibited in positions 4 through 15.
If the MNU exceeds 15 characters, the leftmost 15 characters should be entered in the MNU field.
The full MNU should then be entered in the MIS Field.
18.18.42 MON MONIKER (30)
OPTIONAL
To give Oregon agencies the ability to add “street” names, nicknames, etc. LEDS added a “moniker”
(MON) field to all Oregon person records. This information is not stored in NCIC records. This field is
unique in that it does not exist in the base record. Therefore, the supplemental transaction is the way
to add this information to the record. A maximum number of 9 monikers may be added to any one
record. This field only accepts alpha characters and hyphens ( - ). If the street name of the subject is
8 ball, it would be entered as “eight ball”.

18.18.43 NAM NAME (30)
MANDATORY
Name of subject. Letters, hyphens, a comma, and spaces permitted. Use "LAST, FIRST MIDDLE
OTHER" format.
A second NAM in a modify transaction must not be in delete format (i.e. NAM/.)
Multiple last names, with or without spaces in between, are combined into the entered last name.
Apostrophes are not entered. For last names conjugated by the letter "y", replace the "y" with a
hyphen and join the names together. A single comma is required after the last name.
Hyphens are permitted in the last name only; if a first or middle name is hyphenated, replace the
hyphen with a space. If that creates more names than permitted, remove the space so the two
formerly hyphenated names become one.
Things to know about NAM:
Up to three hyphens are permitted in the last name.
No hyphens are permitted in the first, middle, or other names.
NAM must be at least five characters in length.
Titles and other designations occurring before the first name are not permitted (Ms., Dr., etc).
The usage of surnames from different countries can often be confusing. For example, Hispanics
generally use both their fathers and mothers last name, giving them a double last name. The first
name of this double last name is generally the most important name for record check purposes. If one
does not know how to place these names in the name fields on inquiries, misses could occur.
Below is a short explanation of the construction of names often checked with INS indices.

HISPANIC FIRST NAMES
Many Spanish first names consist of more than one word, for example, Maria de Los Angeles, Maria
de la Luz, and Maria del Carmen.
When written with a prepositional phrase, the name should be treated as one first name.
If the name is not recorded with a prepositional phrase, for example, Maria Luz or Maria Carmen, it
should be considered first and middle names.
HISPANIC SURNAMES
Spanish and Hispanic persons customarily use the surnames of both parents.

This double surname is derived from the first surname of the father and the first surname of the
mother. Neither name is considered a middle name. The surname of the father precedes that of the
mother.
The two surnames may be connected by the word "y", which means "and." For example, Juan
Gomez y Conde has Juan as a first name, Gomez as the surname of the father, and Conde as the
surname of the mother.
For recording purposes, all double last names are listed with the father’s surname followed by the
mother’s surname. Juan Gomez y Conde would be recorded as Juan Gomez Conde.
The nationals of some South American countries do not, as a general rule, use both last names. If the
subject comes from a country that uses both last names, but the subject only uses one, and it is his
mother’s surname, this will often indicate that the subject’s parents were not married.
HISPANIC MARRIED NAMES FOR WOMEN
When she marries, a woman commonly drops the surname of her mother and adds the first surname
of her husband, preceded by the preposition "de." This indicates she is the "wife of" that man.
Maria Gomez Garcia, when married to Juan Martinez Ramirez, would become Maria Gomez de
Martinez and will be recorded as Gomez de Martinez, Maria.
Note that according to traditional Hispanic usage the woman’s surname never changes.
After admission to the United States, however, some women have adopted the American custom of
using the husband's surname as their own. Maria Gomez de Martinez may begin to give her name as
Martinez, Maria Gomez.
ASIAN (CHINESE) NAMES
When a sequence of two, three or four names appear, no part of which can be recognized as the first
name, middle name or surname, the first part only is identified as the surname and the next parts
used as the first name and middle name.
When one of more names follows the surname, use only the first as the surname.
Sometimes the surname will be in capital letters and the other names will be connected by a hyphen.
In such cases you may find the surname written either before or after the other names.

A unique OSP-assigned number for all persons with a fingerprint-based state identification record,
including Oregon criminal history records. It has a check digit. When included in a protection order
record it may be hit by a subsequent query.
The SID is also used by enhanced data entry. When included in a protection order entry message,
without any other personal identifiers, it is used to retrieve personal identifiers from the fingerprint-
based state identification record. That data, in addition to items necessary for a new record, is used to
create a new protection order record.

18.19 PROTECTION ORDERS & FEDERAL PROHIBITIONS CHECK LIST
Persons subject to a qualifying protection order under federal law are generally prohibited from
possessing any firearm or ammunition in affecting commerce (or shipping or transporting any firearm
or ammunition in interstate or foreign commerce, or receiving any such firearm or ammunition).
Violation of this prohibition while the order remains in effect is a federal offense punishable by up to
ten years imprisonment. 18 U.S.C. § 922(g)(8), § 924(a)(2).
The following list enumerates the elements that define a qualifying protection order under the federal
firearms prohibition. Generally, a defendant/subject subject to a protection order that includes one
element (indicated by a diamond) from each section is covered by the federal firearms prohibition.
I. HEARING
◊ Defendant/Subject received actual notice and had the opportunity to participate.
II. INTIMATE PARTNER
Plaintiff/Petitioner is an intimate partner of the Defendant/Subject,
(18 U.S.C. § 921(a)(32)) that is:

◊ an individual who is a parent of a child of Defendant/Subject; or

◊ The order restrains Defendant/Subject from harassing, stalking, or threatening the
intimate partner, child of the Defendant/Subject, or child of the Defendant/Subject’s intimate

◊ The order restrains Defendant/Subject from engaging in other conduct that would place the
intimate partner in reasonable fear of bodily injury to the partner or child.
IV. CREDIBLE THREAT OR PHYSICAL FORCE
◊ The order includes a finding that Defendant/Subject is a credible threat to the physical
safety of the intimate partner or child; or
◊ The order, by its terms, explicitly prohibits the use, attempted use, or threatened use of
physical force against the intimate partner or child that would reasonable be expected to
cause bodily injury.
