16.0 UNIDENTIFIED PERSONS

16.1 FILE DESCRIPTION

The NCIC Unidentified Person file contains records of unidentified deceased persons,

unidentified disaster victims, body parts (when bodies have been dismembered), and living

persons of any age who are unable to establish their identity. Such persons could be amnesia

victims, infants, comatose individuals with no identification, etc.

The NCIC system provides for comparison of unidentified person records with missing person

records on an ongoing basis. When possible matching records are found the agencies that

entered the records are notified of the possible match.

16.2 AUTHORIZED SYSTEM USE

The LEDS, NCIC, and other databases are designed for, and made available to, criminal justice

agencies to aid in the investigation of crimes and prosecution of criminal offences.

In addition, under certain conditions, select governmental non-criminal justice agencies are

granted limited access via specific authority set forth in law, rule, and/or executive order

necessary to fulfill very specific duties of given agency.

Notwithstanding this exception, use of the system as well as all the data entered into or extracted

from any such database(s) is restricted to a Criminal Justice Purpose and the “administration of

criminal justice” which is defined as:

“The performance of any of the following activities: detection, apprehension, detention, pretrial

release, post trial release, prosecution, adjudication, correctional supervision, or rehabilitation of

accused persons or criminal offenders.”

16.2.1 AUTHORITY FOR ENTRY OF UNIDENTIFIED PERSON RECORDS

16.2.1.1 UNIDENTIFIED LIVING PERSONS

Any police agency may enter records for unidentified LIVING persons.

16.2.1.2 UNIDENTIFIED DECEASED PERSONS

ORS 146.505 requires records pertaining to unidentified deceased persons be entered by the

Oregon Department of State Police.

When an unidentified person has been positively identified by partial body parts, the entering

agency may maintain the record for future identification in the event additional body parts are

recovered.

16.4 TIMELINESS OF ENTRY

It is imperative records be accurate and current. The promptness in entering, modifying, clearing,

and canceling of records is the responsibility of the originating agency. All entries must be

checked by a second party to assure accuracy of the information contained in the entry.

Timely modification of a record is that which occurs as soon as possible following the detection

of erroneous data in an existing record, and/or as soon as possible following the receipt of data

not already stored in the record.

Timely removal from the file requires immediate removal of the record once the originating

agency has documentation that the person has been identified.

16.5 RECORD COMPLETENESS – GENERAL

Due to the nature of circumstances surrounding an unidentified person, records must be entered

as soon as you have the minimum information required by the system to make the entry; i.e.

information required for the mandatory fields.

Notwithstanding this urgency, it is imperative to obtain as much identifying information as

possible. It is the sole responsibility of the entering agency to ensure all sources of available

information are checked, and subsequently entered into the system. Sources include, but are not

limited to:

Scars, marks, tattoos, medical conditions

And any and all other information that will result in a more complete record

An agency is required to verify and update the NCIC 2000 unidentified person record with any

additional information, including Blood Type (BLT); Dental Characteristics (DCH); Fingerprint

Classification (FPC); Jewelry Type (JWT); Scars, Marks, Tattoos, and Other Characteristics

(SMT) within 60 days of entry. If a record has a date of entry older than 30 days and any of the

above fields are blank, a $.K. administrative message identifying the blank will be transmitted by

NCIC. The $.K. administrative message will also include the record.

16.5.1 RECORD COMPLETENESS – LINKING CASE INFORMATION

The capability to link records is useful when two or more agencies share the same case, or when

different cases in the same department are associated.

Related records are those with the same ORI/OCA as the primary hit response and all records

linked by the LKI/LKA contained in the primary hit response.

16.5.2 RECORD COMPLETENESS – MISCELLANEOUS (MIS) FIELD

At minimum, agencies must enter a telephone number at which they may be reached 24-hours a

day for confirmation purposes.

MIS must include explanatory information when entering a test record – (enter "TEST RECORD

ONLY" as the first entry in the MIS Field)

16.5.2.1 RECORD COMPLETENESS – MIS FIELD ADDITIONAL INFORMATION

The MIS field should be used for these types of information associated with an unidentified

person:

Clothing description (size, color, style, laundry marks).

Shoes (size, style, color).

Smokes (pipe, cigar, cigarette; brand).

Tobacco chew (brand).

Fingernails (polish, length, bitten).

Possible destination.

Amount of money in possession.

Medication in possession.

Explanation and description of scars, marks, tattoos, and physical characteristics.

If VRX is more than 40 characters, the right lens information should be entered in the VRX field

and the left lens information should be placed in MIS.

16.5.3 RECORD COMPLETENESS – DENTAL INFORMATION

The addition of supplemental dental data to a unidentified persons record greatly increases the

possibility of positive identification of the unidentified person or their remains. These

supplemental data elements are critical to successful computer matching of unidentified (living or

deceased) person records with NCIC missing person records. Dental information is also

important when trying to identify persons who may be unconscious, incoherent, or who refuse to

correctly identify themselves.

Agencies investigating missing person cases must attempt to obtain and subsequently enter

medical and dental information into missing person records within 60 days following system

entry.

16.5.3.1 AUTHORITY TO OBTAIN MEDICAL/DENTAL INFORMATION

ORS 146.535 requires dentists, denturists, physicians, optometrists and/or other medical

practitioners to provide appropriate medical and dental information when requested in writing by

a police agency.

16.5.3.2 DENTAL FORMS

Dental information must be obtained only on approved forms, because the dentist actually

provides the required computer codes when completing the form. The forms required for

16.5.4 FINGERPRINTS

If fingerprints are available, a fingerprint card should be submitted to the Oregon State Police -

Identification Services Section to be searched against fingerprints on file.

16.6 ACCURACY

The accuracy of records is an integral part of the system. The accuracy of a record must be

double-checked by a second party. Agencies lacking staff support for this verification must

require the investigating officer to check the accuracy of the record, as the case officer carries

the primary responsibility for identifying the subject.

The verification of a record must include assuring all available cross checks, e.g. VIN/LIC, were

made and that the data in the record matches the data in the investigative report.

16.7 DUPLICATE RECORDS

Entry and modify messages are rejected if they attempt to create a record that duplicates one

already stored in LEDS.

If a message is rejected for attempting to create a duplicate record, the reject response lists the

record on file and the fields causing the message to be rejected.

Duplicate unidentified person records are records from the same agency with the same case

number (OCA). In those situations when two or more unidentified persons are discovered and

are being assigned one case number by the investigating agency, the case number entered into

the OCA Field of the Unidentified Person File entries will have to be suffixed with a character to

make each OCA unique.

16.8 RECORD VALIDATION

Validation procedures must be formalized and copies of these procedures must be on file for

review during a LEDS and/or FBI CJIS audit. In addition, documentation and validation efforts

must be maintained for review during such audit.

Each month LEDS will send a list of records requiring validation. The list will be accompanied by

a certification form that must be signed and returned to LEDS in a prescribed amount of time. By

signing the form, the LEDS Rep certifies that the validation of those records is complete.

Validation certification means:

The records contained on the validation listing have been reviewed by the originating agencies;

The records which are no longer current have been removed from NCIC 2000 and all records

remaining in the System are valid and active;

The records which are no longer current have been removed from NCIC 2000 and all records

remaining in the System are valid and active;

The information contained in each of the records is accurate.

Agencies failing to return the certification form within the prescribed time frame, as set forth on

the certification form, are subject to having all non-validated records removed from the LEDS and

NCIC Systems. Removal may occur as soon as 0001 hours on the calendar day immediately

preceding the due date.

Validation of records includes conducting the same checks and queries as noted in the

“Timeliness of Entry” Section as noted above. All data contained in each record must be checked

for accuracy in addition to determining if any new data has become available. Further, it is

necessary for the entering agency to verify with the complainant that the missing person has not

been located.

Although the VLD & VLN fields are available for use in the system, since at this time LEDS does

not participate in, nor, offer an option to electronically validate records, use of these fields is

16.9 NIC NUMBERS

Unique NCIC file numbers are assigned to each record entered. These numbers are included in

the computer acknowledgment of the entry and should be retained in the agency case file along

with a copy of the record entered. No entry transaction is complete until the acknowledgment is

received from NCIC.

16.10 LEDS AND NCIC CODES

Only codes listed in the LEDS Manual or the NCIC 2000 Code Manual are allowed in

Unidentified Persons records.

To locate the proper codes for entering or interpreting LEDS and NCIC Unidentified Person

records see the Message Field Code Directory, in section 16.18.

16.11 UNIDENTIFIED PERSON ENTRY

The NCIC record format is the same for unidentified living and unidentified deceased persons.

All data fields must be accounted for. Those fields not used in a record must be accounted for by

a period “.”. If you are using a preformatted mask, the unused fields are just left blank.

Records of unidentified living persons can be entered when all required fields are filled. Any

additional fields for which information is available must be filled.

16.11.1 CONSENTIAL AGREEMENT PRIOR TO ENTRY

The information on unidentified living persons should only be included if the person gives his/her

consent or if they are physically or mentally unable to give consent.

16.11.5 SUPPLEMENTAL ENTRIES TO UNIDENTIFIED PERSON RECORDS

Supplemental entry transactions are used to add additional scars, marks, tattoos, and other

characteristics to an unidentified person record. Supplemental entries can be made only by the

agency that entered the unidentified person record.

Supplemental data cannot be entered for a data field that is not filled in the base record. For

example, a tattoo cannot be entered as a supplemental record if the scars, marks, tattoos, and

other characteristic (SMT) field in the base record is blank.

16.11.5.1 SUPPLEMENTAL ENTRY LIMITATIONS

Supplemental entries to unidentified person records are limited to adding scars, marks, tattoos,

other characteristics, and image data.

Up to nine additional scars, marks, tattoos or other characteristics may be added in a SINGLE

transaction. A maximum of nineteen scars, marks, and tattoos can be appended to an

unidentified person record.

A maximum of thirteen IMN/IMT sets can be appended to an unidentified person record.

16.11.5.2 SUPPLEMENTAL ENTRY CODES

Only codes from the Scars, Marks, Tattoos, and Other Characteristics (SMT) Field Codes section

in the Personal Descriptors chapter of the NCIC 2000 Code Manual are allowed in the SMT field

of a supplemental entry transaction.

16.12 MODIFY TRANSACTION

16.12.1 MODIFY TRANSACTION DESCRIPTION

A modify transaction is used to add, delete, or change information in a base unidentified person

record, or an associated supplemental dental information record.

16.12.2 MODIFY TRANSACTION PROCEDURE.

A missing person record can only be modified by the agency that made the original entry.

Records must be immediately modified when it is determined:

• Data contained in the record is incorrect, or

• Additional data has been located that is not included in the record

16.12.2.1 DELETION OF DATA FROM A RECORD

To delete data from a field, enter the message field code followed by a slash and a period. (e.g.

EYB/.)

16.13 BENEFITS AND EFFECTIVENESS DATA

Benefits and effectiveness data is collected by the LEDS and NCIC systems to provide users

with a means of collecting data associated with solved cases. This data is mandatory on all

transactions.

Monthly summaries and other reports from benefits and effectiveness data may be obtained by

contacting the LEDS Operations Center at (503) 378-5565.

Entry of benefits and effectiveness data is not mandatory but it does provide valuable

statistical information.

RPP must be present to use any of the other benefits and effectiveness fields

16.14 CLEAR TRANSACTION

16.14.1 CLEAR TRANSACTION DESCRIPTION

A clear transaction must be entered when the person has been identified.

16.14.2 CLEAR TRANSACTION PROCEDURE

An unidentified person record must be cleared when the entering agency identifies the person or

is officially advised the person has been identified by another agency.

The clear transaction will remove the unidentified person record and any supplemental records

appended to it.

16.14.3 BENEFITS AND EFFECTIVENESS DATA

Benefits and Effectiveness data may be included in the clear transaction.

16.15.1 CANCEL TRANSACTION DESCRIPTION

A cancel transaction deletes a record that is in error or is no longer valid from the Unidentified

Persons file. Cancellations can be done only by the agency that entered the record.

16.15.2 CANCEL TRANSACTION PROCEDURES

Records must be cancelled when it is determined the record:

• is no longer valid

• is not correctable using a modify message and therefore must be re-entered

• was entered for training purposes and its use is no longer needed

Benefits and Effectiveness data may be included in the cancel transaction.

and reason for person record removal (RPS) as shown in the following example. A cancellation

can be done only by the entering agency.

16.17.4 BODY PARTS STATUS INQUIRY

The body parts status inquiry is for use when a police agency has recovered part, but not all, of a

body. The inquiry is searched against all unidentified dead body records that have at least one body

part coded “N” (not recovered). Abbreviated records of all unidentified bodies that could match the

body parts (BPS) inquiry will be returned. You may obtain any full record by making inquiries using

the NCIC number of the desired record.

The number of abbreviated records returned may be limited to those of the same sex, race, and/or

to records entered from a specific geographic area.

Optional fields which may be used with the BPS inquiry to limit the number of responses are:

SEX: The use of the sex field in the inquiry will limit the responses to those

records that contain a matching sex code or a sex code of “U” for unknown.

If the sex of the recovered body is unknown the sex field should not be

used.

16.18 MESSAGE FIELD CODES DIRECTORY

Each message transaction is comprised of multiple data elements; this section provides the

necessary information on data elements for these transactions. Each data element is identified

by a specific field name. Each field name is abbreviated with a unique three or four character

code called a message field code (MFC). The MFC’s are sorted alphabetically, then followed by

16.18.9 DCH DENTAL CHARACTERISTICS – 319

MANDATORY

1. The DCH Field describes the status of each tooth, restorations for each surface of the tooth

(MODFL), missing (X), virgin (V), no information remembered (/), root canal (R), or crown (C).

1. An NCIC 2000 Missing Person Dental Report, or one similar, can be completed by a

dentist or forensic odontologist and returned to the user for entry.

2. If all 32 permanent teeth are present with no restorations, the agency can enter the code

ALL in the DCH Field. If the agency enters ALL in the DCH Field, it cannot add information,

and the system transmits the following after the DRE Field in a positive response:

ALL 32 PERMANENT TEETH ARE PRESENT WITH NO RESTORATIONS

Note: If an agency enters ALL in the DCH Field, the code V will be used for all 32 teeth,

and the system will generate a dental cross-search comparison.

3. If dental characteristics are not available for coding, then the agency should enter UNK in

the DCH Field. If the agency enters the code UNK in the DCH Field, the system transmits

the following after the DRE Field in a positive response:

DENTAL CHARACTERISTICS (DCH) ARE NOT AVAILABLE

Note: If an agency enters UNK in the DCH Field, NCIC will not generate a dental cross-

search comparison.

2. The codes must be entered using a comma as a separator with the exception of the last code

which must be followed by a period (field delimiter) or logical end of transmission.

3. If the agency does not enter the code ALL or UNK, the only valid codes shall be 01 through

32. Each code shall be used only once. These codes shall be followed by the appropriate

letter(s) or special character (e.g., 01M).

A modification of any code for the 01 through 32 tooth codes will replace any coding for that

specific tooth, (for example, 01MO was initially entered, 01FL was modified into the record, the

record will then list only 01FL). If new codes must be added to the existing codes for a tooth,

the existing codes must be reentered along with the new codes, (for example, 01MO was

initially entered for tooth number 1 and FL must be added, then 01MOFL should be entered to

list 01MOFL).

4. The DCH Field shall contain a maximum of 32 codes, separated by commas, consisting of two

numerics followed by option 1, 2, or 3:

1. One special character /, or one special character / followed by R.

2. One alphabetic character M, O, D, F, L, X, or V.

3. Two to seven alphabetic characters M, O, D, F, L, C, and R.

5. Any combination of M, O, D, F, or L should be entered in the sequence of M, O, D, F, L.

6. The R character should follow any combination of M, O, D, F, L, C or the / character.

7. The C character should follow any combination of M, O, D, F, or L.

8. The only character that should be used with / is the R character.

9. The characters V and X should not be used with any combination of characters.

10. The characters M, O, D, F, L, C, R, /, V, and X may be used only once per numeric.

16.18.10 DCL DATE OF CLEAR – 8

MANDATORY

Date format, which is YYYYMMDD. Date record cleared. Must be today or prior to today.

16.18.11 DLO DNA LOCATION – 250

CONDITIONAL

Mandatory with DNA “Y” – used as a set

Prohibited otherwise – must be left blank

All characters except period, slash, single quote and double quote permitted. Use to describe the

location of the DNA sample, the type of DNA sample, contact information, ORI, and CODIS

number. (The Combined DNA Index System (CODIS) is an FBI database of genetic information.)

16.18.12 DNA DNA PROFILE INDICATOR – 1

OPTIONAL

Must be either "Y" or "N". Indicates whether or not a DNA sample is available. See DLO for more

information. "Y" or "N" indicates whether or not a DNA sample is available.

When DNA is "Y" in entry messages, DLO is required.

When DNA is "N" in entry messages, DLO must be blank.

When DNA is "N" in modify messages, DLO is automatically removed from the record.

16.18.13 DOC DATE OF CANCELLATION – 8

MANDATORY

Date format, which is YYYYMMDD. Date record canceled. Must be today or yesterday.

16.18.14 DRE DENTIST’S REMARKS – 50

OPTIONAL

This field should contain dental remarks that cannot be coded in the DXR or DCH fields.

Nine characters as follows. Four numerals representing the earliest estimated year of birth, a

hyphen, then four numerals representing latest estimated year of birth. E.g. 1950-1954. The

maximum range allowed is 20 years.

If the year of birth has been definitely established the years entered must be equal. E.g.

1950-1950.

16.18.18 EYE EYE COLOR – 3

MANDATORY

Must be a code from the Eye Color Field Codes Section of the Personal Descriptors chapter of

the NCIC 2000 Code Manual.

16.18.19 FPA FOOTPRINTS AVAILABLE – 1

OPTIONAL

"Y", "N", or blank. Flag indicating that footprints of the unidentified person are available.

16.18.20 FPC FINGERPRINT CLASSIFICATION – 20

OPTIONAL

Fingerprint classification code.

See the Fingerprint Classification (FPC) Field Codes section in the Personal Descriptors chapter

of the NCIC 2000 Code Manual for a detailed description of this field.

16.18.21 HAI HAIR COLOR – 3

MANDATORY

Must be a code from the Personal Descriptors chapter of the NCIC 2000 Code Manual.

Note: The code “BLD” is permitted only in III (CCH) records. For other NCIC qualified records use

the code “XXX” for completely bald and enter “BALD” in the Scars, Marks, Tattoos and Other

Characteristics Field (SMT).

16.18.22 HGT APPROXIMATE HEIGHT – 7

MANDATORY

Approximate height in feet and inches, using three digits. Fractions of an inch should be rounded

to the nearest inch. For example, a person 6' 2" tall would be coded as 602.

The range entered must have the lower estimated height in positions 1 through 3 and the higher

estimated height in positions 5 through 7. The two heights must be separated with a hyphen and

the difference between them must not exceed 6 inches. The maximum permitted height is 7' 11".

If the exact height is known then enter it twice separated with a hyphen.

If the height is not known then “UNK” should be entered in the first three positions.

16.18.23 IMN NCIC IMAGE NUMBER – 10

An NCIC-assigned number. It is the alphabetic "I" followed by nine digits. IMN/IMT must be

entered or deleted together, as a set. IMN/IMT may not be modified.

correspond with JWT codes used.

16.18.27 JWT JEWELRY TYPE – 50

Must be a code from the Jewelry Type (JWT) Field Codes in the Personal Descriptors chapter of

the NCIC 2000 Code Manual. Up to 17 codes, separated by commas, may be used.

16.18.28 LKA LINKAGE CASE NUMBER – 20

CONDITIONAL

Mandatory with LKI – used as a set

Otherwise must be left blank

To specify other Oregon records in NCIC as being related records. Enter the ORI of the related

record in LKI and the OCA of the related record in LKA.

The LKI and LKA must match at least one ORI and OCA in an existing LEDS record. If the

current message is NCIC Qualified then at least one of the ORI-and-OCA-matching records must

be NCIC Qualified.

The LKI and LKA cannot match the ORI and OCA in the same message. The LKI and LKA must

be entered, modified, or deleted together, as a set.

The characters permitted in LKA are letters, numbers, hyphens, and spaces (same as OCA).

The capability to link records is useful when two or more agencies share the same case, when

different cases in the same department are associated and to link missing and/or unidentified

person records when an identification is made but only part of the body has been recovered.

When a record is hit by a query using the RSH/Y option, all records related to it will also be

returned. Related records are those with ORI and OCA matching the hit record's LKI and LKA or

ORI and OCA. (For clarification see Query section examples.)

MANDATORY

NCIC-assigned number used to identify records in NCIC. It is a letter followed by nine digits.

"Y" or "N". Indicator used to request notification when record is hit. NCIC sends a $.H.

administrative message to the ORI of record when an inquiry, enter, or modify transaction results

in a hit response; and the Notify Originating Agency (NOA) flag is set to Y. Defaults to "N" if

unused. This replaces the use of "NOAH" in the MIS field which did not generate an automatic

message but directed the user to contact the owner of the record.

16.18.45 VRX CORRECTIVE VISION PRESCRIPTION - 40

Prescription for glasses as written by a doctor. See the Personal Descriptors chapter of the NCIC

2000 Code Manual for a detailed description of this field.

If the vision prescription contains more than 40 characters, the right lens information should be

entered in the VRX field and the left lens information in the MIS field. Letters, numbers, spaces,

commas, hyphens, plus signs, dollar signs, ampersands, and slashes ("/") are allowed.

Decimal points (periods), equals signs, and times signs ("×") are not permitted. In these

The range entered must have the lower estimated weight in positions 1 through 3 and the higher

estimated weight in positions 5 through 7. The two weights must be separated with a hyphen and

the difference between them must not exceed 50 pounds. The minimum is 001, the maximum is

499. Leading zero(s) are required when less than one hundred pounds.

If the exact weight is known then enter it twice separated with a hyphen.

If the weight is not known then “UNK” should be entered in the first three positions.
