I. INTRODUCTION

SCOPE

The Criminal Justice Statistics Center (CJSC) collects criminal justice data from law

enforcement agencies in California through the Monthly Arrest and Citation Register (MACR)

reporting system. Using this information, the CJSC publishes regular reports, conducts special

studies, and responds to special requests for statistical data.

PURPOSE

The MACR reporting system collects information on all adult and juvenile arrests and citations

in California. Information developed from the system provides statistical arrest data for local,

county, regional, and state agencies and is used by the Federal Bureau of Investigation (FBI) in

their annual accounting of arrests in California and the United States.

AUTHORITY

California law enforcement agencies are required to forward monthly reports to the Department

of Justice (DOJ) under the authority of California Penal Code Sections (PC) 13010-13012 and

13020-13023.

II. GENERAL INFORMATION

SUBMITTING THE MACR REPORT

DUE DATE

The MACR report is due within ten (10) working days after the end of each calendar month. For

example, February data is due the 10th working day of March.

DELINQUENT MACR REPORTS

The DOJ will contact agencies that have not submitted their MACR reports in a timely manner:

RESOLVING ERRORS

Agencies that submit data that do not meet the DOJ reporting requirements will be contacted by

telephone, letter, or field visit to resolve questions and/or reporting requirements. Contributing

agencies should provide the CJSC with a current list of telephone numbers and individuals who

may be contacted when questions arise or reporting errors need to be resolved.

REPORTING METHODS

The MACR report can be submitted in the following formats:

MANUAL REPORTS

Arrest and citation data can be reported by completing a Monthly Arrest and Citation Register

form (JUS 750).

Submission: Completed JUS 750 forms must be mailed to the Criminal Justice Statistics

Center, P.O. Box 903427, Sacramento, CA 94203-4270.

COMPUTER PRINTOUTS

Computer printouts for the MACR are acceptable provided they are in the same format as the

JUS 750. Race should be reported with the appropriate alpha code. Sex, Level, Status, and Law

Enforcement Disposition should be reported with the appropriate numeric code. Birthdate and

Date of Arrest should be eight-digit numeric codes (e.g., 01/06/1945).

If more than one page of the register is filled out during the month, number the pages

consecutively. The juvenile arrest data should follow the adult arrest data. For example, if there

are 20 pages of adults and 5 pages of juveniles, pages 1-20 should be adults and pages 21-25

should be juveniles. A sample printout should be sent to the CJSC to resolve problems PRIOR

to submitting actual data.

E-CARS (version 5.0) - No internet access required

If your agency does not have access to the Internet, the Electronic-Crime and Arrest Reporting

System (E-CARS) software (available on CD-ROM) contains two reporting programs: Crime

and Clearance and the Monthly Arrest and Citation Register. E-CARS allows law enforcement

agencies that do not utilize a record management system to easily collect and report statistical

data. Agencies can collect criminal statistics, ensure the data is complete and correct, maintain a

statistical database, and generate agency reports. Statistical data are exported on to a diskette or

CD-ROM for submitting to the DOJ.

For agencies with record management systems, report layout specifications are available to

generate files that adhere to the DOJ reporting requirements and conditional checks. Data files

must be submitted to the DOJ on a diskette or CD-ROM. See record layout specifications on

E-CARS PLUS - Internet access required

If your agency has access to the Internet, E-CARS Plus is a web-based application that consists

of three reporting programs: Crime and Clearance, Monthly Arrest and Citation Register, and

Anti-Reproductive-Rights Crimes.

This application can be used by agencies with or without a records management system. If your

agency does not have a records management system, data can be directly keyed into E-CARS

Plus. For agencies that utilize a records management system, data in the proper format (see

record layout specifications on pages can be uploaded into E-CARS Plus. No matter

which method is used, the data are run through edits and conditional checks to ensure they are

complete and correct. Error resolution and corrections to data are also handled within this

electronic environment. The data are secure within the DOJ network and received within

minutes of submission. E-CARS Plus eliminates the risk of losing data in the mail and reduces

your agency’s mailing costs. Expenses for media, such as floppy diskette and CD-ROM, are also

eliminated.

For a “hands-on” demonstration of E-CARS Plus, an interactive training CD is available upon

request. Additional features of the web application include on-line help and built-in statistical

reports. For more information about reporting your statistical data via E-CARS Plus, please

Submission: Data are electronically submitted to the DOJ over a secure network.

III. REPORTING STANDARDS

Arrest/Citation Data

The MACR reporting system collects information on all adult and juvenile arrests and citations

in California. Information developed from the system provides statistical arrest data for local,

county, regional, and state agencies and is used by the Federal Bureau of Investigation (FBI) in

their annual accounting of arrests in California and the United States.

The MACR system includes arrest data on all persons processed by arrest, citation, or summons

for committing an offense within the reporting jurisdiction. Include: (1) Those persons arrested

and released without a formal charge being placed against them. An arrest has occurred when a

law enforcement officer detains an adult with the intention of seeking charges against the person

for a specific offense and a record is made of the detention; (2) Juveniles taken into custody or

arrested and are merely warned and released without being charged.

Data on persons taken into custody for other jurisdictions should not be reported by the arresting

agency. The agency for whom the arrest was made, i.e., the jurisdiction where the offense

occurred, will report the arrestee data, and thus, duplication in reporting will be avoided.

Because of the wider range of police involvement in juvenile control than in the control of adults,

a major problem is to specifically define police contacts that, for statistical purposes, are arrests

and those that are not considered arrests. The word “arrest” as it applies to juveniles is intended

to mean the law enforcement handling of all juveniles (under age 18) who have committed a

crime and are taken into custody under such circumstances that, if the juvenile were an adult, an

arrest would have been reported. An adult is usually held for prosecution for some charge or is

released for future handling in court.

Juvenile Arrests for Statistical Purposes

• Contacts that require an action subsequent to the initial contact are arrests. Contacts of

this type include those that result in the transportation of juveniles to the officer’s

headquarters and a subsequent arrest report or booking record completed whether

released to parents, placed in a juvenile hall, jail, or other detention facility, or released on

their own recognizance. Included in the group are juveniles released after they have been

issued citations wherein they agree to appear at the probation department, before a

juvenile officer, or other person within the police agency for further consideration of the

case. Note that each type of action listed requires an action subsequent to the initial

contact.

• Some situations require only initial contacts to qualify as an arrest. These are contacts

where the juvenile’s responsibility for an offense is admitted, but the incident is recorded

and closed by the police during the initial interview. For example, a juvenile has stolen

property from a neighbor. The officer called to the scene may apprehend the juvenile,

reprimand him, secure the return of the property, and conclude the entire case without the

necessity of subsequent action.

• Any situation where a juvenile, in lieu of an actual arrest, is summoned, cited, or notified

to appear before a juvenile or youth court or similar authority for a violation of the law

should be reported as an arrest.

Not Considered Juvenile Arrests for Statistical Purposes

• Contacts that do not require subsequent action generally are in the field contact or field

interrogation category and are not considered an arrest. They involve situations where

juveniles are stopped, questioned, or identified, and possibly reprimanded or requested to

disperse or return home. In these situations, no further action is taken by the police and

the matter is closed.

• Requests during field contacts for juveniles to call at the officer’s headquarters or some

other specified location for an interview are not considered an arrest. These

appointments, usually investigative interviews, are considered voluntary actions by the

juvenile. If the juvenile refuses to comply with the officer’s request, and is thereafter

ordered to comply, his compliance would then be considered an arrest.

• Instances wherein juveniles are taken into custody for their own protection (e.g., neglect

cases) should not be recorded as arrests.

• “Call backs” or “follow up contacts” with juveniles by officers for the purpose of

determining their progress should not be counted as “arrests.”

TYPES OF RECORDS TO REPORT:

Bench warrants

See the “Warrants" section on pp. 20-21 for more information.

Bookable arrests

Bookable arrests for criminal and traffic offenses.

Citations for misdemeanor offenses

Such as shoplifting, petty theft, possession of marijuana, etc., where the maximum penalty

involved is more than a fine.

Civil drunk arrests

Per California Penal Code (PC) 647(G).

Contempt of Court

e.g., 166 PC, 213 W&I, 1209 CP, 1331.5 PC and subsections.

Failure to register

By narcotics (11594 Health and Safety [HS]), sex (290[G] PC) and arson (457.1 [H] PC)

offenders.

Federal offenses

Give the specific offense, for example illegal alien, narcotic offense, or military (AWOL). For

statistical purposes, federal offenses are always classified as “felony-level (3)” offenses, status is

“booked (2),” and the disposition is “turned-over (2).”

Juvenile contacts handled beyond a mere field interview

See the “Juvenile Arrests for Statistical Purposes” section on pp. 9-10 for an explanation.

Misdemeanor Traffic Violations

Defined in California Vehicle Code Sections 40000.5 - 40000.25. Some misdemeanor traffic

violations are optional for reporting to the CJSC. Arrests for these traffic violations will be

shown on the CJSC tabulations as “Misd. Traffic” under “Other Reported Offense” and not

included in misdemeanor arrest totals. (See Appendix 4, Misdemeanor Traffic Violations.)

Probation and parole violations

If a subject is arrested on a local charge and for violation of probation or parole, only the most

serious charge should be reported. If the probation or parole violation is the most serious charge,

specify if the offense is a felony (F) or misdemeanor (M) violation.

Traffic warrants

e.g., 40508(A)-(C) VC - failure to appear (for this type of warrant, specify the violation as

“40508 VC” rather than the original traffic offense) and 42005(G) VC - failure to attend traffic

school.

RECORDS NOT COLLECTED BY THE CJSC:

Additional charges

Charges placed against a person already in custody; person is re-booked.

Commitments or re-entered commitment

Official confinement of a subject.

Enroutes

Transporting a subject from one destination to another.

Further investigation

Conducting further investigation of a crime report.

Infractions

An offense punishable by fine or other penalty, but not incarceration.

Mentally ill

5150 Welfare and Institutions (W&I).

Missing persons

Defined per California Penal Code 14213.

Parole or probation holds

A subject was picked up because there was probable cause to believe that he/she was violating a

term or condition of his/her parole or probation. A “hold” is put on the subject so they cannot

bail out.

Protective custody

300 W&I.

Re-booking

The booking of a subject by an agency other than the original arresting agency without a new

physical arrest or additional charges. This generally occurs when the arresting agency does not

have holding facilities.

Registrations

By narcotic (11590 HS), sex (290 PC), and arson (457.1 PC) offenders.

Sleepers or safekeeping

e.g., protective custody.

Victims

e.g., sick, casualty, injured.

Violations of non-bookable county and municipal ordinances

For which a fine is the maximum penalty imposed.

COMPLETING THE JUS 750

The sample JUS 750 form below is numbered to correspond with the field descriptions that

follow. Fill out all required fields completely.

1. HEADING (required)

AGENCY

Enter the name of your agency.

AGENCY NUMBER

Enter your agency’s ORI/NCIC number. Agencies should abbreviate the nine-character NCIC

code on the MACR report by using the fourth through seventh character of the NCIC code. For

example, if your NCIC number is “CA0570100,” report “5701” only.

PREPARED BY

Enter the name of the person who should be contacted by the DOJ regarding corrections.

TELEPHONE NUMBER

Enter the area code and telephone number of the person to be contacted if questions arise on

specific line items.

MONTH

Enter the reporting month and year.

ADULT OR JUVENILE

Arrest data for adults (age 18 years and older on the date of arrest) and juveniles (age 17 years or

younger on the date of arrest) must be separated. Check the proper box to indicate if the data on

the page submitted is adult or juvenile. If an agency has no adult or juvenile arrests for a month,

"no adults to report" or "no juveniles to report" box must be checked.

PAGE NUMBER

If more than one page of the register is filled out during the month, number the pages

consecutively. The juvenile arrest data should follow the adult arrest data. For example, if there

are 20 pages of adults and 5 pages of juveniles, pages 1-20 should be adults and pages 21-25

should be juveniles.

2. LOCAL REFERENCE NUMBER (required)

Enter the most reliable number for locating the arrested person in your agency's files in case

questions arise. This can be the booking, arrest, or crime report number.

3. NAME (required)

Print legibly or type the last name, middle name or initial (if known), and first name of the

arrestee. If name is unknown, use “John Doe” or “Jane Doe.”

4. RACE (required)

Record only one alpha designation that applies. Agencies submitting automated reports must

verify that the appropriate codes are being entered. Do not report the race as "Unknown."

Record the appropriate alpha code for race. Do not use "other" for unknown race.

The racial and ethnic codes and definitions for statistical reporting are as follows:

A - Other Asian

A person who may be Asian, but whose specific ethnic origin is not known or declared,

or none of the other Asian codes apply. This allows for "sight identification" by officers

in the field.

B - Black

A person whose ancestry is in any of the black racial groups of Africa.

C - Chinese

A person whose ancestry is in China.

D - Cambodian

A person whose ancestry is in Cambodia.

F - Filipino

A person whose ancestry is in any of the Philippine Islands.

G - Guamanian

A person whose ancestry is in Guam.

H - Hispanic

A person of Mexican, Puerto Rican, Cuban, Central or South American or other Spanish

culture or origin, regardless of race.

I - American Indian

(or Alaskan native). A person whose ancestry is in any of the original peoples of North

America and who maintains cultural identification through tribal affiliation or community

recognition.

J - Japanese

A person whose ancestry is in Japan.

K - Korean

A person whose ancestry is in Korea.

L - Laotian

A person whose ancestry is in Laos.

O - Other

A person who cannot be linked to any of the general or specific racial/ethnic groups listed

on the JUS 750 form.

P - Pacific Islander

A person who cannot be identified as belonging to one of the listed Pacific Island

racial/ethnic groups such as Samoan, Guamanian, or Hawaiian.

S - Samoan

A person whose ancestry is in Samoa.

U - Hawaiian

A person whose ancestry is in Hawaii.

V - Vietnamese

A person whose ancestry is in Vietnam.

W - White

A person whose ancestry is in any of the original peoples of Europe, North Africa, or the

Middle East.

Z - Asian Indian

A person who can be identified as belonging to one of the listed Asian/Eastern Indian

racial/ethnic groups such as Pakistani, Bangladeshi, Nepal, Ceylonese, or Afghanistani.

5. BIRTHDATE (required)

Use eight-digits: two each for the month and day, and four for the year. For example, a birthdate

of January 9, 1949 should be entered as: 01/09/1949.

If the month and day are not known, use February 30 for the month and day and show the year of

birth. For example, if the year of birth is 1945, enter the following: 02/30/1945. Do not write in

the age. If the age is known, but not the date of birth, subtract the age from the present year and

enter the resulting year of birth.

6. SEX (required)

Enter either (1) Male or (2) Female.

7. DATE ARRESTED (required)

Use eight-digits: two each for the month, and day, and four for the year. For example, an arrest

made on February 9, 2006 should be entered as: 02/09/2006.

8. LEVEL (required)

Select the level (delinquent, misdemeanor or felony) that best describes the most serious offense.

Enter only one level per arrest or citation.

NOTE: In multiple offense situations, the level should reflect the most serious charge in all

cases. That is the charge which is the most severe in terms of potential sentencing.

(1) DEL.

The “(1) delinquent” in the level column refers to a delinquent act by juveniles. It is used only

when reporting 777 W&I or 601 W&I Code offenses. Report “777 (A)(1) W&I - Fail to obey

order of juvenile court” as “777 (A)(1) W&I” in the charges column. When reporting 601 W&I

offenses, the offense description such as runaway, truancy, curfew, or incorrigible must be

written out in the charges column. Record the complete offense description when the offense is a

“local ordinance.” DO NOT report protective custody (300 W&I).

(2) MISD. and (3) FEL.

If an adult or juvenile is arrested on a misdemeanor or felony, enter level (2) or (3) as applicable.

9. CHARGES (required)

• Report only one offense per date for each arrestee regardless of the number of charges

involved.

• Record only the most serious offense (i.e., the offense with the greatest potential

sentencing or the lowest hierarchy code).

• Enter the exact statute (Penal Code, Health and Safety Code, etc.), section number, and

appropriate subsection.

CHARGES EXAMPLES

Scenario Charge Entry

enforcement disposition will always be “(2) Turned Over” for

statistical purposes.

Codes or 602 W&I, record the actual offense description for the

arrest. Either 601 or 602 W&I alone does not describe the

offense and cannot be coded by the CJSC.

If it is a 601 W&I charge, indicate whether it is “runaway,

incorrigible, truant, or curfew.”

If it is a 602 W&I charge, indicate the specific offense such as

“459 PC.”

Multiple Local Charges* If an individual is arrested on multiple charges, report only the

most serious charge (the offense with the greatest potential

sentencing or the lowest hierarchy code).

Municipal (MC), City and Juvenile: Record the actual offense description (e.g.,

County (CC) Codes “truant”).

Adult: Use only “MC” or “CC.” For statistical reports, adult

“MC” and “CC” violations are combined into one offense

category.

WARRANTS

It is necessary to identify the specific type of warrant served because warrants are reported

differently on the MACR (e.g., local warrants of arrest, local bench warrants, local traffic

warrants, and outside warrants).

Type of Warrant Description

Local Warrant of A warrant issued by the court for a crime committed within your

Arrest jurisdiction, accusing the defendant named and described. This is the

first time the defendant is arrested for the crime. DO NOT indicate

warrant arrest.

Example: A crime of felony 459 PC occurred on January 31. An investigation was completed

APPENDIX I

Frequently Asked Questions

1. Do I report all the charges involved in an incident?

The MACR collects only one arrest per date for each person within a jurisdiction. Record only the

offense with the highest possible punishment.

2. At what age is a person considered an “adult” for the MACR?

If a person is 18 years or older on the date of arrest, he/she is reported as an adult.

3. Do I have to submit a report if we do not have any arrests or citations for the month?

If an agency does not have any juvenile or adult arrests or citations for the month, a Negative Report

must be submitted.

4. What does an “S” in the level column indicate on the Offense Look Up screen in E-CARS

Plus?

The “S” in the level column refers to “status” which is a delinquent act committed by juveniles. It is

used only when reporting 777 W&I or 601 W&I Code offenses. When reporting 601 W&I offenses,

enter the desired offense description such as runaway, truancy, curfew, or incorrigible.

5. If I have a juvenile arrest for 601 W&I or 602 W&I, do I have to specify the offense?

When a juvenile arrest is made on the authority of either 601 or 602 W&I, record the actual offense

description for the arrest. If it is a 601 W&I charge, enter the description that indicates whether it is

runaway, incorrigible, truant, or curfew violation. If it is a 602 W&I charge, enter the specific offense

(e.g., 459 PC).

6. Do I need to specify the type of warrant?

It is necessary to identify the specific type of warrant served because each type is reported differently on

the MACR. The three types of warrants accepted in the MACR are bench warrant, traffic warrant, and

outside warrant. A bench warrant or traffic warrant is issued when a person “fails to appear” in court

on an original charge. All warrants that are issued for agencies other than your own are outside

warrants.

7. How do I report warrants?

A “local warrant” arrest is for the first time a defendant is arrested for a crime. Do not report “warrant

arrest;” record the charge only (e.g., 484 PC).

For bench warrants, traffic warrants, and outside (out of agency) warrants, do not record the original or

actual charge.

Bench warrants or traffic warrants are reported as follows:

Felony bench warrant: “B/W-Fel.”

Misdemeanor bench warrant: “B/W-Misd.”

Traffic warrant: “40508 VC”

Outside warrants are recorded as follows:

Felony: “O/W-Fel.”

Misdemeanor: “O/W-Misd.”

Disposition: “(2) Turned Over”

8. Do outside warrants always have a “turned over” disposition?

The disposition on outside warrants must be “(2) turned over” for juveniles and adults, since the agency

which issued the warrant reports the arrest.

9. How do I record a failure to appear for vehicle code offenses?

A traffic warrant is issued when a person fails to appear (40508 VC) for vehicle code offenses and is

reported as “40508 VC.” Do not report the original traffic offense.

10. How do I report a conspiracy crime?

If the conspiracy is reported with other charges, ignore the conspiracy charge. Use the hierarchy on the

remaining charges to determine the most serious charge to report.

11. I do not know the disposition to enter in the law enforcement disposition column.

This column is intended for the disposition of the agency reporting the arrest or citation. Record the

disposition taken with the charge, not with the person being arrested (e.g., “released” refers to the

charge being released, not the release of the suspect). Do not report the district attorney or court

disposition. Only one disposition is allowed per entry.

12. When are the MACR reports due?

Reports are required within ten (10) working days after the end of each calendar month; e.g., February

data is to be reported by the tenth working day in March.

Glossary of Terms

Adult

A person 18 years of age or older.

Arrest

(California Penal Code Section 834)

“... taking a person into custody, in a case and in the manner authorized by law. An arrest may be made

by a peace officer or by a private person.”

(California Penal Code Section 835)

“An arrest is made by an actual restraint of the person, or by submission to the custody of an officer.

The person arrested may be subjected to such restraint as is reasonable for his arrest and detention.”

BCS Offense Code

Three-digit numeric code that groups similar statute codes into major offense group categories.

Book

An adult is actually booked into jail for any period of time or booked into jail and later released on a

citation or when a juvenile is booked into a juvenile holding facility of any type (an arrest report is

filled out).

Citation

A written order, issued by the police for a violation, to appear before a magistrate or probation officer at

a later date.

Delinquent

Those acts described under Welfare and Institutions Code section 602 which involve violations by a

juvenile of any law or ordinance defining crime, or the violation of a court order of the juvenile court.

Department

A situation that has been handled within the department, e.g., settled by the arresting agency, no action

is to be taken by the juvenile probation department or the court, and the juvenile is released to his/her

parents, guardian, or the street with a warning. Also used when a juvenile is placed on a local diversion

program including, for statistical purposes, any juvenile deemed not arrested or cited.

Hierarchy

Assigned and used by the CJSC to prioritize statute codes from least to most severe in terms of

potential sentencing. The most serious charge has the lowest hierarchy number.

Juvenile

A person under the age of 18.

Juvenile Court

A juvenile that is referred to juvenile court or turned over to the probation department, welfare agency,

other police agency, criminal or adult court, or juvenile hall.

Law Enforcement Disposition

An action taken as the result of an arrest. Examples of police dispositions are: adults - charge is

released by law enforcement, referred to another jurisdiction, or a misdemeanor or felony complaint

sought; juveniles - handled within the department, referred to another agency, or referred to the

probation department or juvenile court.

Local Bench Warrant (Failure to Appear Warrant)

A warrant issued by the court for a defendant’s arrest because he/she has missed a scheduled court

appearance on an original charge.

Local Charge (local offense)

A violation of a charge committed within your jurisdiction. Includes California Statute Codes, Vehicle

Codes, local ordinances, county codes, and municipal codes.

Local Traffic Warrant

A warrant issued when a person fails to appear for vehicle code violations should be recorded as

“40508 VC.”

Local Warrant of Arrest

A warrant issued by the court for a crime committed within your jurisdiction, accusing the defendant

named and described. This is the first time the defendant is arrested for the crime.

Other

An adult makes bail on a warrant and is neither cited nor booked, or was detained for civil drunk

occurrences per 647(G) PC. Also used when juveniles are neither cited nor booked (e.g., detained only,

sent to a diversion program, referred to probation department, etc.). Use “other” when no arrest report

has been filled out.

Outside Warrant

Refers to OUT OF AGENCY warrants, not out of county warrants. This includes all warrants, bench

warrants, and traffic warrants issued for another agency.

Release

Each arrest released under 849(B) PC, or other sections, when no further action is planned by the

arresting agency. Refers to the release of the charge, not the person.

Status

The status column describes the type of apprehension at the time of initial contact with the arrestee. It

determines how many individuals are cited versus those actually delivered to jail.

Turned Over

Indicates the arresting agency has turned the matter over to another law enforcement agency for

prosecution.

A Other Asian - A person who may be Asian, but whose the specific ethnic origin

is not known or declared, or none of the other Asian codes apply. This allows for

“sight identification” by officers in the field.
