Overview

This Technical Specification is a guide for vendors and law enforcement agencies who electronically

submit Uniform Crime Reporting data via NIBRS guidelines.

Since the Department has developed their system to closely match the national program, we have

instead focused on a document that is truly "Texas - Centric". This Technical Specification is intended to

be an addendum to the FBI User Manual Technical Specifications, specifically designed for Texas data

and Texas law enforcement.

For Data Quality purposes, DPS has added Texas Specific validations that supersede the NIBRS

guidelines. These validations will be proceeded by T-XXX. (e.g. T-221)

Segment Levels 8 & 9 - Additional Texas Data Elements

When to Submit Segment Levels 8 and 9

Segment Level 8 should be submitted as part of a complete incident under the following circumstances:

1. when the incident involves Crimes Against a Person or Robbery and familial relationship(s).

2. when there are more than three types of drugs involved in a drug seizure case.

3. when marijuana plants were seized from a garden, wild field, cultivated field, or greenhouse.

4. when clandestine labs or precursor chemicals were seized as part of an incident.

Segment Level 9 should be submitted as part of a complete incident under the following circumstances:

1. when the incident involves a sexual assault (per Texas Penal code definitions).

2. when the offense is related to one of the following nine mandated Texas Penal Codes:

01 = Continuous Sexual Abuse of Young Child or Children

02 = Indecency with a Child by Contact

03 = Indecency with a Child by Exposure*

04 = Sexual Assault

05 = Aggravated Sexual Assault

06 = Sexual Performance by a Child

07 = Indecent Assault – Group A (11D)

08 = Indecent Assault – Group B (90C)*

09 = Sexual Assault Donor w/o Consent

*Note: Even though NIBRS does not require Group B offenses to be reported without an arrest, the Texas

Penal Codes require these sex offenses to be reported to the Department. In some cases, when it is the

only offense, these incidents could be reported as a standalone Segment 9 segment line (e.g., 90C =

Disorderly Conduct without an arrest, but connected to Indecency with a Child by Exposure or Indecent

Assault – Group B).

Sec. 411.042. BUREAU OF IDENTIFICATION AND RECORDS

(b) The bureau of identification and records shall:

(2) collect information concerning the number and nature of offenses reported or known to

have been committed in the state and the legal steps taken in connection with the offenses, and

other information useful in the study of crime and the administration of justice, including

information that enables the bureau to create a statistical breakdown of:

(A) offenses in which family violence was involved.

Texas Family Code, sec. 71.004 which defines ‘Family Violence’ also includes ‘Dating Violence’ in this

collection.

Submission Requirements

An incident should be flagged as family violence when the incident involves Crimes Against a Person or

Robbery, and at least one of the relationships of the victim to offender is:

PA = Parent SP = Stepparent

SB = Sibling SC = Stepchild

CH = Child SS = Stepsibling

GP = Grandparent XR* = Ex-Relationship (Ex-Boyfriend/Ex-Girlfriend)*

*NIBRS does not include these relationships under familial, but based on Texas-mandate these are

included in Texas Family Violence reporting which includes Dating Violence relationships.

**OK = Otherwise Known (e.g., Roommates) can be familial or non-familial. See Family Violence

Indicator below for rules.

Segment Level 8 – Data Elements and Values (Family Violence)

Character spaces 001-004 define the Segment Length and 005 define the Segment Level. From character

spaces 006-037 of Segment Level 8 correspond to the same character spaces for each of the six levels

associated with a Group “A” Incident. A description of the additional Data Elements specific to Family

Violence are as follows:

Incident Date - 8 characters; spaces 038-045: Enter the date of the incident in the proper format

(YYYYMMDD).

Family Violence Indicator - 1 character; space 046: Enter “Y” to indicate family violence occurred in this

incident.

Note: When using relationship code OK, you must indicate a “Y” or “N” for family violence, as this

relationship code can be familial or non-familial.

Drug Seizures

Texas Health and Safety Code

Sec. 481.185. ARREST REPORTS

(a) Each law enforcement agency in this state shall file monthly with the director a report of all

arrests made for drug offenses and quantities of controlled substances seized during the

preceding month. The agency shall make the report on a form provided by the director and

shall provide the information required by the form.

(b) The director shall publish an annual summary of all drug arrests and controlled substances

seized in the state.

Submission Requirements

The national UCR program collects NIBRS data on up to three different types of drugs seized within a

single incident. However, Texas-mandates require ALL drug-related offenses and seizures be reported,

so Segment 8 requires additional information.

Segment Level 8 must be submitted for drug seizure if it meets one of the following criteria:

1. When more than three types of drugs are involved, the type of measurement for the two

most important drugs (as determined by the reporting agency based on the quantity, value,

and deadliness of the drugs/narcotics) should be reported in Segment Level 3 Measurement

Type 1 and Measurement Type 2; Measurement Type 3 enter X = Over Three Drug Types. Up

to an additional fourteen drug types can be captured in Segment Level 8.

2. Any time marijuana plant(s) are seized in a garden, wild or cultivated fields, and/or

greenhouse.

3. Any time clandestine lab(s) or precursor chemical(s) were seized as part of an incident.

Segment Level 8 – Data Elements and Values (Drug Seizures)

Suspected Drug Type – 1 character; space 047: This Data Element is to be used to identify the types of

drugs or narcotics seized in an incident. This field is used when the types of drugs seized exceeds three

(submitted in Segment Level 3).

Example: If one of the offenses in the incident was 35A = Drug/Narcotic Violation, 6 = Seized was

entered into Data Element 14 (Type Property Loss/Etc.), and 10 = Drugs/Narcotics was entered into Data

Element 15 (Property Description) and over three drug types were involved, enter the two most

important (as determined by the reporting agency based on quantity, value, and deadliness of the

drugs/narcotics) in Segment Level 3, and enter X = Over Three Drug Types in the third occurrence in

Data Element 20 (Suspected Drug Type).

No quantity indicator is required for the “Over Three Drug Types” category. Enter the remaining drugs in

Segment Level 8.

Valid data values for types of drugs/narcotics for reporting are:

A = Crack Cocaine

B = Cocaine (all forms except Crack)

C = Hashish

D = Heroin

E = Marijuana (including THC)

F = Morphine

G = Opium

H = Other Narcotics – Codeine; Demerol; Dihydromorphinone or Dilaudid; Hydrocodone or

Percodan; Methadone, Pentazocine; Propoxyphene or Darvon; etc.

I = LSD

J = PCP

K = Other Hallucinogens – BMDA or White Acid; DMT; MDA; MDMA; Mescaline or Peyote;

Psilocybin; STP; Spice; Dronabinol or Marinol; etc.

L = Amphetamines/Methamphetamines (includes Methcathinone); P2P

M = Other Stimulants – Adipex, Fastine, and Ionamin (Derivatives of Phentermine); Benzedrine;

Didrex; Khat; Bath Salts; Methylphenidate or Ritalin; Phenmetrazine or Preludin; Tenuate;

etc.

N = Barbiturates

O = Other Depressants – Glutethimide or Doriden; Methaqualone or Quaalude; or Talwin; etc.

P = Other Drugs – Antidepressants (Elavil, Triavil, Tofranil, etc); Aromatic Hydrocarbons;

Tranquilizers (Chlordiazepoxide or Librium, Diazepam or Valium, etc.); Steroids; Synthetic

Narcotics (e.g., Fentanyl); etc.

U = Unknown type

X = Over three drug types (can only be used in NIBRS Segment Level 3 in the third occurrence

of Data Element 20 (Suspected Drug Type))

Note: This is not a comprehensive list; these are examples.

Estimated Drug Quantity – 12 characters; spaces 048-059: This Data Element is used to indicate the

quantity of drugs or narcotics seized in an incident. The left-most 9 characters are for the whole number

of pounds, ounces, etc. The right 3 characters are for decimal values.

If the substance was sent to a laboratory for analysis and a response has not yet been received,

1 = None should be entered into Data Element 21 (Estimated Drug Quantity). When the agency receives

the results of the laboratory analysis, the agency must update Data Elements 21 (Estimated Drug

Quantity) and 22 (Type Drug Measurement).

Type Drug Measurement – 2 characters; spaces 060-061: This Data Element is used to indicate the type

of measurement in quantifying drugs or narcotics seized in a drug case. It is used only if one of the

offenses in an incident was 35A = Drug/Narcotic Violation, 6 = Seized was entered into Data Element 14

(Type Property Loss/Etc.), and 10 = Drugs/Narcotics was entered into Data Element 15 (Property

Description) and over three drug types were involved.

If the substance was sent to a laboratory for analysis and a response has not yet been received,

XX = Not Reported should be entered. When the agency receives the results of the laboratory analysis,

the agency must update Data Elements 21 (Estimated Drug Quantity) and 22 (Type Drug Measurement).

Type Marijuana Fields and Gardens – 1 character; space 257: This field is used when marijuana seized

was in a garden, wild field, cultivated field, or greenhouse. If there was no seizure of marijuana fields

and gardens, leave blank. Valid Data Values:

1 = Gardens

2 = Wild Fields

3 = Cultivated Fields

4 = Greenhouses

Note: If multiple types of Fields and Gardens are involved in the drug seizure, list the type that the largest

amount was seized from and report overall total number of plants.

Number of Marijuana Fields and Gardens – 1 character; space 258: This field is used to indicate the

number of Gardens, Wild Fields, Cultivated Fields, or Greenhouses that were seized. The valid values

are 1-9. If there was no seizure of marijuana fields and gardens, leave blank.

Example: if marijuana in two greenhouses were seized, 4 = Greenhouses would be entered in Type

Marijuana Fields and Gardens and “2” would be entered to indicate the number of greenhouses.

Type of Drug Manufactured and Number of Clandestine Labs Seized – 1 character; spaces 259-264: This

Data Element is used to indicate the type of drug manufactured and number of clandestine labs seized

in an incident. The valid values are 1-9 for each lab seized. If there were no lab seizures, leave blank.

Enter total lab seized for each drug type in appropriate data field.

Quantity of Precursor Chemical Seized – 7 characters; spaces 265-271: Enter the quantity of the

precursor chemical seized. Enter a whole number value only. If fractional values are involved, round to

the nearest whole number.

Type Measurement for Precursor Chemical Seized – 2 characters; spaces 272-273: This Data Element is

used to indicate the type of measurement in quantifying precursor chemicals seized. If no precursor

chemicals seized, leave blank. Valid entries are:

Note: Up to six entries are allowed for the quantity and type measurement for precursor chemicals.

Entries should be made in the lowest numbered occurrence.

Example: if three precursor chemicals are seized, information on these chemicals should be forwarded

in occurrences 1, 2, and 3 of this data element. Occurrences 4, 5 and 6 should be blank.

The multiple occurrences of Data Element T8 (Quantity of Precursor Chemical Seized) and Data Element

T9 (Type Measurement of Precursor Chemical) character spaces 265-318 are to allow for seized

precursor chemicals that are measured in different units.

Example: if one chemical is measured in pounds and another one is measured in liters, then two

occurrences would be needed to report this information. However, if two chemicals are seized and both

are measured in pounds, combine the quantities and report the amount in the first occurrence in

character spaces 265-273.

Sec. 411.042. BUREAU OF IDENTIFICATION AND RECORDS

(h) Information collected to perform a statistical breakdown of offenses under Sections 22.011 and

22.021, Penal Code, as required by Subsection (b)(2) must include information indicating the

specific offense committed and information regarding:

(1) the victim;

(2) the offender and the offender’s relationship to the victim;

(3) any weapons used or exhibited in the commission of the offense; and

(4) any injuries sustained by the victim.

(i) A law enforcement agency shall report offenses under Section 22.011 or 22.021, Penal Code, to

the department in the form and manner and at regular intervals as prescribed by rules adopted

by the department. The report must include the information described by Subsection (h).

Submission Requirements

Segment Level 9 must be submitted when the incident involves an offense conneced to any of the Penal

Codes listed below. This data collection will collect information on specific Texas Penal Code offenses

listed below, and includes data beyond what NIBRS collects.

Segment Level 9 – Data Elements and Values (Sexual Assault)

Character spaces 001-004 define the Segment Length and 005 define the Segment Level. Character

spaces 006-037 of Segment Level 9 match the formatting of a NIBRS segment levels 1-6.

A description of the additional Data Elements specific to Sexual Assault are as follows:

Action Type - 1 character; space 006: Action Type determines the kind of database activity that is to be

performed.

Submission Month - 2 characters; spaces 007-008: Submission Month is defined as the month the

submission is created.

Submission Year - 4 characters; spaces 009-012: Submission Year is the year in which the Submission

Month occurs.

City Indicator - 4 characters; spaces 013-016: Leave intentionally blank.

ORI – 9 characters; spaces 017-025

Incident Number – 14 characters; spaces 026-037

Incident Date - 8 characters; spaces 038-045: Enter the date of the incident in YYYYMMDD format.

Victim Sequence Number - 3 characters; spaces 046-048: Left zero fill up to 001-999. Cannot be blank.

Offender Sequence Number - 2 characters; spaces 049-050: Left zero fill up to 01-99. 00 = Unknown

NIBRS codes should be programmed to the appropriate Texas Sex Offense codes.

FBI NIBRS codes 11A, 11B, 11C and 11D should always be reported with a segment 9.

FBI NIBRS codes 370 and 90C are conditionally reported with a segment 9, if any offense meets the

Texas Penal code criteria.

a) 370 = Pornography/Obscene Material related to Sexual Performance by a Child.

b) 90C = Disorderly Conduct related to Indecency with a Child by Exposure.

c) 90C = Disorderly Conduct related to Indecent Assault with victim 17 years of age or

older.

Clarification for Crime Against Society connected to specific Texas sex offense

370 is a Group A - Crime Against Society offense and does not contain victim/offender demographics or

any specific information for crimes against a person per NIBRS guidelines. However, if the 370 offense

relates to Sexual Performance by a Child, then it needs to be reported in Segment 9 and requires

additional information about the incident per Texas Penal Code.

Clarification for Group B Sex Offenses (without an arrest)

90C is a Group B offense and is only included in the NIBRS Segment 7 (Group B Offenses) when there is

an arrest per NIBRS guidelines. However, if the 90C offense relates to Indecency with a Child by

Exposure (with victim under 17 years of age) or Indecent Assault (with victim 17 years of age or older),

then it needs to be reported in Segment 9; even without an arrest. In some cases (without any other

Group A offenses or Group B arrest), this sex offense (Indecency with a Child by Exposure and Indecent

Assault – Group B (90C)) could be reported in Segment 9, without any NIBRS segments levels (1-7).

*Per Texas penal code "Child" means a person younger than 17 years of age.

Conditional Data Element and Values

Characer spaces 071-127 are required if offense is related to any of the following penal codes:

03 = Indecency with a Child by Exposure

06 = Sexual Performance by a Child

08 = Indecent Assault – Group B (90C)

Arrest Transaction Number (ATN) – 12 characters; spaces 071-082: The ATN must follow the NIBRS

guidelines when an arrest is reported for these penal codes. If there is no arrest these characters must

be blank.

Arrest Sequence Number – 2 characters; spaces 083-084: The Sequence Number must follow the NIBRS

guidelines when an arrest is reported for these penal codes and when an ATN is present it cannot be

blank. If there is no arrest these characters must be blank.

Victim Age – 2 characters; spaces 085-086: Victim Age must be one of the following valid entries:

01-98 = Years Old

NN = Under 24 Hours

NB = 1-6 Days Old

BB = 7-364 Days Old

99 = Over 98 Years Old

00 = Unknown

Note: Data Element 26 (victim age) any combination of years 01-98 is valid for an age range. Age ranges

are limited to 5 – 10 year ranges. If the age is not known, then use “00” = Unknown. The youngest age

in the range must be listed as the age for that victim in Segment 9. Example: For Data Element 26 (victim

age) “2530” is a valid age range. This would be entered as “25” for victim age in Segment 9.

ranges are limited to 5 – 10 year ranges. If the age is not known, then use “00” = Unknown. The

youngest age in the range must be listed as the age for that offender in Segment 9. Example: For Data

Element 37 (offender age) “2530” is a valid age range. This would be entered as “25” for offender age in

Segment 9.

Offender Sex – 1 character; space 092: Victim Sex must be one of the following valid entries:

Offense Weapon – 3 characters (2 characters for Weapon Type, plus a 3rd character for the optional

Automatic Weapon Indicator); spaces 097-105: Entries are left-justified, must start in left-most data

field, with blank right fill, and up to 3 unique weapon types can be reported. There should be no gaps

between multiple weapon data fields, except for the Automatic Weapon Indicator. Valid Entries:

70 = Drugs/Narcotics/Sleeping Pills

85 = Asphyxiation

90 = Other (BB guns, pellet guns, tasers, pepper spray, stun guns, etc.)

95 = Unknown

99 = None (Mutually Exclusive)

Note: Reporting agencies should insert the letter “A” in the third character field for this Data Element to

indicate an automatic weapon was involved in an incident. Reporting agencies should leave this data

element blank if an automatic weapon was not involved in the incident.

The optional Automatic Weapon Indicator is valid only with the following Weapon Types:

11 = Firearm

12 = Handgun

13 = Rifle

14 = Shotgun

15 = Other Firearm

Note: Automatic means the weapon is fully automatic by design or manufacture, not by modification.

Offense Injury – 1 character for each injury type; spaces 106-110: Entries are left-justified, must start in

left-most data field, with no blanks between multiple values, with blank right fill, and up to 5 unique

injury types can be reported. Valid entries:

N = None (Mutually exclusive)

Errors - Texas Specific for NIBRS Segments

T-202 Must be Left justified – Blank detected in first position or gap between values. When

reporting Data Elements 8, 8A, or 13, Entries are left-justified, must start in left-most

data field, with no blanks between multiple values, and with blank right fill.

T-203 Offense code 36B Statutory Rape is not reportable in Texas. Statutory Rape is the non-

forcible sexual intercourse with a person who is under the statutory age of consent. The

victim is not capable of giving consent, according to the Texas Penal Code, Chapter 22

definition of “Child”.

T-208 Illogical Data Value (Location). Data Element 9 (Location Type) entered for each

offense must be the same valid data value in an incident when multiple offenses are

reported.

T-221 Type Weapon/Force Involved cannot be NONE for specific offenses. Data Element 13

(Type Weapon/Force Involved) must be populated with a valid data value and cannot be

toward whom the robber(s) directed force or threat of force in perpetrating the offense.

T-551 Illogical INCEST when Offender is under 17 years of age. When Data Element 6 (UCR Offense

Code) is 36A = Incest, the Offender cannot be under 17 years of age, based on Texas Penal Code which

Errors - General

T-801 Must be Present – Mandatory Field. The data field must be entered; it is required.

T-810 Duplicate Segment 8 on file. When Segment level 8 is submitted, the segment cannot

be duplicated.

T-815 Cannot have embedded blanks between first and last non-blank characters. Data

Element 2 (Incident Number) contained embedded blanks between the first and last

significant characters.

T-816 Must be left justified – Blank detected in first space. Data Element 2 (Incident

Number) must be left justified with blank right fill. Since the number is less than 12

characters, it must begin in space 1; one or more blanks were entered starting in space

1 followed by the data.

T-817 Cannot have characters other than A-Z, 0-9, Hyphen, and/or blank. Data Element 2

(Incident Number) can only have character combinations of A-Z, 0-9, Hyphen, and/or

blanks. For example, 93-123-SC is valid, but 93+13*SC is invalid.

T-818 Invalid Segment Level 8 Incident Date. Data Element 3 (Incident Date) contains a date

that is not entered correctly. Each component of the date must be valid; this, months

must be 01-12, days must be 01-31, and the year must include the century (i.e., 19xx,

20xx). In addition, days cannot exceed maximum for the month (e.g., June cannot have

31 days). The date cannot exceed the current date.

T-820 Invalid Family Violence Indicator – Must be Y or N. Data Element T2 (Family Violence

Indicator) must be valid code of Y = Yes or N = No when submitted.

drug type. Based upon the various ways a drug can be measured, very few edits can be

done to check for illogical combinations of drug type and measurement. Limited to

NP = Number of Plants to the following drugs: E = Marijuana, G = Opium and K = Other

Hallucinogens. All other Data Element 22 (Type Drug Measurement) codes are

applicable to any Data Element 20 (Suspected Drug Type) code.

T-825 Same Drug Types– Measurements must be different. If more than one Suspected Drug

Type is entered in Data Element 20 (Suspected Drug Type), they cannot be entered with

the same Type Drug Measurement category.

Example: Cocaine cannot be reported in grams and pounds (same weight category) but

could be reported in grams and liters (weight and capacity categories).

T-826 If Suspected Drug Type is Entered, Estimated Drug Quantity and Type Drug

Measurement must not be blank. Data Element 20 (Suspected Drug Type) was entered,

but Data Element 21 (Estimated Drug Quantity) or Data Element 22 (Type Drug

Measurement) was not entered; both must be entered.

T-827 Estimated Drug Quantity must be numeric with zero left fill. Drug Quantity must be a

numeric entry with zero left fill. Any decimal fractional quantity must be expressed in

thousandths as three numeric digits. If no fractional quantity is involved, then all zeros

should be entered.

T-828 If Estimated Drug Quantity is not blank, Type Drug Measurement and Suspected Drug

Type must not be blank. Data Element 21 (Estimated Drug Quantity) was entered, but

Data Element 20 (Suspected Drug Type) or Data Element 22 (Type Drug Measurement)

T-829 If Type Drug Measurement is not blank, Suspected Drug type and Estimated Drug

X = Over 3 Drugs Types in Segment Level 3 for values to be placed in the Segment Level

8 drug overflow table.

T-841 Drug Overflow table must have a value if X exists in Level 3. The Drug overflow table

must contain valid entries in Data Elements 20-22 if X = Over 3 Drugs Types is coded in

the third occurrence in Segment Level 3.

T-842 If Type Marijuana Fields and Gardens has a value then Suspected Drug Type must be

E = Marijuana. If submission of Segment 8 is associated with an incident and Data

Element T4 (Type Marijuana Fields and Gardens) is not blank, Data Element 14 (Type

Robbery, Forcible Sex Offenses, Non-Forcible Sex Offenses and Human Trafficking are

collected for family violence incidents. All other offenses will not be accepted if they are

flagged as family violence incidents.

T-847 Duplicate Suspected Drug Type. Data Element 20 (Suspected Drug Type) cannot

contain duplicate measurement type values. Each entry must be different.

T-848 Estimated Drug Quantity cannot be 0 when Suspected Drug Type or Type Drug

Measurement is present. If reporting Unknown drug quantity, please refer to the most

current NIBRS User’s Manual for proper reporting guidelines.

T-883 Duplicate Type Measurement for Precursor Chemical. Data Element T9 (Type

Measurement for Precursor Chemical) cannot contain duplicate measurement type

values. Each entry must be different. Precursor chemicals of the same measurement

type should be totaled together.

T-884 Estimated Drug Quantity must be NONE when Suspected Drug Type is not reported.

Data Element 21 (Estimated Drug Quantity) must be entered as 1 = None

(i.e., 000000001000) when Data Element 22 (Type Drug Measurement) is XX = Not

Reported in Segment 8 indicating the drugs were sent to a laboratory for analysis. LEAs

must update this interim report with the true quantity once they receive the lab results.

T-901 Must be Present – Mandatory Field. Submission Month cannot be blank and must be a

valid value between 01-12. Submission Year cannot be blank and must be a numeric

entry between 1991-Current Year. Incident Number cannot be blank.

T-902 Incident Hour must be blank or numeric 00-23. 2 characters: Standard military time

used to identify the hour of the incident. If the hour is unknown, leave blank.

T-904 Victim Sequence Number must be 001-999. The Victim Sequence Number for Segment

9 (046-048) and from (Data Element 23) must be between 001-999 and cannot contain

alpha characters.

T-905 Offender Sequence Number can be 01-99. Offender Sequence Number for Segment 9

(049-050) and from (Data Element 36) can between 01-99 and cannot contain alpha

characters. If the number of offenders is unknown enter 00 = Unknown Offender.
